This section amends the federal first-degree murder statute (18 U.S.C. 1111) applicable within the special maritime and territorial jurisdiction of the United States—such as national parks, military bases, and federal waters—to (1) add "distributing fentanyl" to the list of predicate offenses (e.g., arson, kidnapping, child abuse) for felony murder; (2) specify that whoever is guilty of first-degree murder by distributing fentanyl shall be punished by death or life imprisonment; and (3) define relevant terms, including "distributing fentanyl" as knowingly distributing a controlled substance involving 2 grams or more of a mixture containing a detectable amount of fentanyl (N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] propanamide) or 0.5 grams or more of a fentanyl analogue that results in death.
