S. 1513 — Lower Elwha Klallam Tribe Project Lands Restoration Act

This section takes approximately 1,082.63 acres of federal land in Olympic National Park, as depicted on the map entitled “Olympic National Park Proposed Transfer of Elwha Lands” (No. 149/178020, Dec. 2021), into trust for the benefit of the Lower Elwha Klallam Tribe in Washington and incorporates the land into the tribe's reservation, without requirements for valuation, appraisal, or equalization. It directs the Secretary of the Interior to survey the land boundaries as soon as practicable after enactment and authorizes minor boundary adjustments or corrections to maps or descriptions. Of the trust land, the portion of the Elwha River subject to specified provisions of the Elwha River Ecosystem and Fisheries Restoration Act (P.L. 102-495) must be managed in accordance with the policy declaration of the Wild and Scenic Rivers Act (16 U.S.C. 1271)—which preserves selected rivers in free-flowing condition for scenic, recreational, and conservation values—subject to necessary modifications under the Elwha Act; and it prohibits the land from being used for gaming under the Indian Gaming Regulatory Act (25 U.S.C. 2701 et seq.).

This section states that nothing in this Act affects treaty rights under the Treaty of Point No Point (i.e., the treaty between the United States and the S'Klallam Indians, concluded January 26, 1855).
