S. 1543 — Veterans Opportunity Act of 2025

This section establishes the Veterans Economic Opportunity and Transition Administration (VEOTA) as a new component within the Department of Veterans Affairs (VA), effective October 1 of the first fiscal year after enactment. VEOTA, headed by the Under Secretary for Veterans Economic Opportunity and Transition who reports directly to the Secretary, administers (1) vocational rehabilitation and employment programs (i.e., job training and employment services primarily for veterans with service-connected disabilities), (2) educational assistance programs (i.e., GI Bill benefits), (3) veterans' housing loan and related programs (i.e., VA-guaranteed home loans), (4) the Transition Assistance Program (TAP) under 10 U.S.C. §1144 (i.e., employment and benefits counseling for separating service members), and (5) other VA programs as determined by the Secretary. The Secretary must include in VA's annual report to Congress (under 38 U.S.C. §529) program-specific metrics for VEOTA-administered programs, including claims received and decided, average processing time, successful outcomes, full-time equivalent employees, and information technology expenditures. This section preserves labor rights and collective bargaining agreements for transferred VA employees and expresses the sense of Congress that VEOTA's creation and program transfers from the Veterans Benefits Administration neither alter VA's budget or spending levels nor justify changes in full-time equivalent employees.

This section establishes in the Department of Veterans Affairs a new Under Secretary for Veterans Economic Opportunity and Transition (appointed by the President with Senate confirmation based on expertise in administering veterans economic opportunity programs and information technology), who heads the new Veterans Economic Opportunity and Transition Administration and reports directly to the Secretary. (As background, this new administration oversees VA programs related to veterans' education and training, vocational rehabilitation, employment, housing, mortgage finance, and survivor benefits—previously housed within the Veterans Benefits Administration.) The section specifies procedures for filling vacancies, including establishment of a commission by the Secretary to recommend at least three qualified individuals to the President. It also makes conforming amendments to 10 sections of title 38, U.S. Code, to (1) include the new Under Secretary in various advisory boards, commissions, and personnel processes; (2) strike certain subparagraphs in section 306; and (3) adjust oversight provisions in sections 7701 and 7703. The new position, administration, and amendments take effect on October 1, 2025.

This section requires the Secretary of Veterans Affairs to submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives (1) not later than 180 days after enactment, a report on progress toward establishing the Veterans Economic Opportunity and Transition Administration (VEOTA)—newly created under section 8001 of title 38, U.S. Code, by section 2 of this bill—and transitioning services to it; and (2) a certification, no earlier than April 1 and no later than September 1 of the first fiscal year after enactment, that transferring services to VEOTA will not negatively affect veterans and that the services are ready for transfer. The section prohibits transferring any veteran services to VEOTA until this certification is submitted. If the certification is not submitted by the deadline, the Secretary must submit a report explaining the reason for the delay and providing an estimated certification date.
