S. 157 — CONTAINER Act

This section authorizes a Border State (i.e., a state adjacent to the U.S. northern border with Canada or southern border with Mexico) to place a movable, temporary structure on Federal land (i.e., land under the jurisdiction of specified agencies—including the Bureau of Indian Affairs, Bureau of Land Management, Bureau of Reclamation, Forest Service, U.S. Fish and Wildlife Service, and National Park Service—adjacent to those borders) for border security purposes without a special use authorization, if the state provides notice to the Secretary concerned (i.e., Secretary of the Interior or Agriculture, as applicable) at least 45 days in advance. Placement is allowed for up to one year, with extensions in 90-day increments subject to approval by the Secretary concerned after consultation with the Commissioner of U.S. Customs and Border Protection; such approval is required if the Commissioner determines that operational control (as defined in the Secure Fence Act of 2006) has not been achieved.
