S. 165 — Stopping Overdoses of Fentanyl Analogues Act

This section amends Schedule I of the Controlled Substances Act (21 U.S.C. 812(c)) by adding fentanyl-related substances—including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, unless specifically exempted or listed in another schedule—as controlled substances. Fentanyl-related substances are defined as any substance structurally related to fentanyl by one or more of the following modifications: (1) replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted; (2) substitution in or on the phenethyl group with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups; (3) substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups; (4) replacement of the aniline ring with any aromatic monocycle, whether or not further substituted; or (5) replacement of the N-propionyl group by another acyl group. (Thus, such substances have a high potential for abuse, no currently accepted medical use in treatment in the United States, and a lack of accepted safety for use under medical supervision.) The amendment takes effect one day after enactment.
