S. 1672 — Forest Protection and Wildland Firefighter Safety Act of 2025

This section expands the exemption from National Pollutant Discharge Elimination System (NPDES) permit requirements under CWA section 402(l)(3)(A) to include, in addition to certain silvicultural discharges, discharges resulting from the aerial application of a product used for fire control and suppression that appears on the Forest Service's most current Qualified Products List (or successor list). (As background, NPDES permits, issued by states or EPA, regulate point source pollutant discharges into U.S. waters to meet water quality standards.) It also makes conforming and technical changes to section 402(l)(3)(C).
