S. 1678 — Securing America's Ports of Entry Act of 2025

This section directs the Commissioner of U.S. Customs and Border Protection (CBP), subject to appropriations, to hire, train, and assign 1,000 new CBP officers above the current attrition level each fiscal year until the total number of CBP officers meets and sustains requirements identified annually in CBP's Workload Staffing Model (WSM), which determines staffing needs at ports of entry based on inspection workloads. The section further (1) authorizes CBP to hire, train, and assign support staff (e.g., technicians and mission support personnel) for non-law enforcement administrative functions to support these new officers; (2) requires WSM calculations at each port of entry to incorporate inspection data, seasonal and projected commercial/passenger volumes (including pre-COVID-19 historicals), and outbound inspection needs; and (3) mandates the Government Accountability Office (GAO) to review CBP hiring practices and report to specified congressional committees if CBP fails to hire the 1,000 officers in FY2026 or any subsequent fiscal year when WSM requirements are unmet.

This section directs the Commissioner for U.S. Customs and Border Protection to submit to the Senate Committees on Homeland Security and Governmental Affairs and Finance and the House Committees on Homeland Security and Ways and Means, not later than 90 days after enactment of this Act, a report identifying (1) infrastructure improvements at ports of entry to enhance U.S. Customs and Border Protection officers' interdiction of opioids and other illegal drugs, including circumstances at specific ports preventing deployment of technology used elsewhere; (2) detection equipment to identify opioids, precursors, and derivatives; and (3) safety equipment to protect officers from accidental drug exposure or dangers associated with inspecting potential drug traffickers.

This section establishes reporting requirements for U.S. Customs and Border Protection (CBP), including (1) quarterly reports to specified congressional committees on temporary duty assignments of CBP officers—detailing numbers of assignments and officers, affected ports of entry (including those with reimbursable services agreements), duration, costs, and support for southern border operations; (2) advance notice (at least 10 days, absent emergencies) to port directors and impacted facilities of planned redeployments; and (3) briefings to affected CBP employees on mitigating staffing vulnerabilities at ports of entry. It further amends annual reporting requirements on CBP reimbursable services agreements (i.e., programs where private entities reimburse CBP for overtime services at ports of entry) under section 907(a) of the Trade Facilitation and Trade Enforcement Act of 2015 (19 U.S.C. 4451(a)) by (1) striking from paragraph (3) the assessment of economic and security benefits provided by the agreement; (2) inserting as new paragraph (4) a description of factors considered before entering the agreement, including such an assessment; (3) redesignating paragraphs (4) through (12) as (5) through (13); and (4) requiring the services description in redesignated paragraph (5) to include locations and total hours of reimbursable services provided. Finally, it requires CBP's annual staffing report under section 411(g)(5)(A) of the Homeland Security Act of 2002 (6 U.S.C. 211(g)(5)(A)) to include progress toward CBP officer and support staff hiring targets (accounting for attrition), updates to the September 12, 2017, Resource Optimization at the Ports of Entry report, and summaries of the quarterly temporary duty reports and reimbursable services agreement reports.
