S. 1682 — Alex Gate Safety Act of 2025

This section requires the Consumer Product Safety Commission (CPSC) to promulgate, not later than one year after enactment and using notice-and-comment procedures under 5 U.S.C. §553 (bypassing the advance notice of proposed rulemaking otherwise required under CPSA section 9), a consumer product safety standard for covered gates that requires such gates to meet ASTM F900–25, ASTM F1184–23e1, ASTM F2200–24, or ANSI/CAN/UL 325 (as applicable), as of January 1, 2025, or any successor standards. The section further (1) directs CPSC to determine the types of covered gates subject to the standard within its jurisdiction; (2) incorporates revisions to those voluntary standards automatically 180 days after the developing organization notifies CPSC (or later), unless CPSC objects within 90 days that the revision does not improve safety; (3) authorizes CPSC to initiate future rulemaking to further reduce covered gate injury risks; and (4) treats the standard (including revisions) as a consumer product safety rule under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058).

This section directs the Commission to undertake, not later than two years after enactment, a national campaign to educate the public on the dangers of covered gates—including detached or falling gates—and prevention methods such as low-cost options, safety standards, and best practices for design, installation, inspection, maintenance, and improvement. The campaign must include educational materials at a minimum for (1) covered gate manufacturers, contractors, retailers, and service companies; (2) consumers, owners, and operators of covered gates; and (3) building officials and local educational agencies to support updating and enforcing building codes. Not later than three years after enactment, the Commission must submit to Congress a report summarizing actions taken under the campaign.

This section establishes definitions for terms used in the Act. It defines (1) building official as any state, tribal, territorial, or local official responsible for proposing modifications to building codes, participating in adopting building codes, interpreting building code requirements, overseeing building code enforcement, or administering building codes; (2) Commission as the Consumer Product Safety Commission; (3) covered gate as an automatic or manual vehicular gate or any other gate more than 48 inches wide or 84 inches or greater in height; (4) local educational agency as having the meaning given in the Elementary and Secondary Education Act of 1965; (5) manufacturer as having the meaning given in the Consumer Product Safety Act; (6) positive stops as an immovable component that physically impedes the motion of a covered gate; and (7) State as having the meaning given in the Consumer Product Safety Act.
