S. 1812 — Ban Birth Tourism Act

This section establishes a new ground of inadmissibility under INA §212(a)(10) for aliens seeking admission as nonimmigrants under INA §101(a)(15)(B) (i.e., B-1/B-2 visitor visas) primarily to give birth in the United States to obtain citizenship for the child. It includes a rule of construction clarifying that the provision does not apply to aliens seeking legitimate medical treatment relating to childbirth where obtaining citizenship for the child is not the primary purpose.
