S. 1817 — Expedited Removal Expansion Act of 2025

This section revises the expedited removal process (i.e., summary removal without a hearing before an immigration judge for certain inadmissible arriving aliens and border crossers) by (1) eliminating the exception for unaccompanied alien children described in former subparagraph (F); (2) authorizing the Secretary of Homeland Security to apply expedited removal without geographic or time limitations to any alien inadmissible under INA §212(a)(6) (fraud or misrepresentation) or (7) (lack of valid documents), at the Secretary's sole and unreviewable discretion; (3) transferring relevant authority from the Attorney General to the Secretary of Homeland Security; (4) raising the credible fear interview standard from "significant possibility" of persecution or torture to "clear and convincing evidence" of eligibility for asylum, withholding of removal, or protection under the Convention Against Torture; and (5) striking former subparagraph (F) and redesignating subparagraph (G) as (F). (Thus, expedited removal may now be applied more broadly to undocumented aliens anywhere in the U.S., subject to fewer restrictions and a higher bar for asylum screening.)
