S. 1827 — Expedited Removal of Criminal Aliens Act

This section establishes expedited removal under new INA §238A (8 U.S.C. 1228A) for aliens whom DHS determines are (1) members of a criminal gang or criminal organization; (2) members of, or material supporters of, a foreign terrorist organization designated under INA §219(a) (8 U.S.C. 1189(a)); or (3) convicted of any felony, any misdemeanor against a member of a vulnerable group (i.e., child under 16 years of age, pregnant woman, individual with severe physical or mental disability, or individual over 65 years of age), assault of a law enforcement officer, sexual offense, crime of domestic violence, stalking offense, crime against children (including sex trafficking of a minor or sexual abuse of a minor), activity relating to material involving sexual exploitation of minors, or violation of a protection order. Such aliens are subject to mandatory detention and expedited removal under INA §238 (8 U.S.C. 1228) and are ineligible for withholding of removal under any INA provision. (Thus, these aliens face accelerated removal proceedings without access to standard protections against removal to countries where their life or freedom would be threatened.)
