S. 1830 — Right to Treat Act

This section prohibits, notwithstanding any other provision of law and subject to a rule of construction—(1) any Federal agency, including the Food and Drug Administration, National Institutes of Health, and Centers for Disease Control and Prevention, from regulating the practice of medicine; and (2) any Federal law, rule, regulation, or policy from prohibiting or restricting prescriptions or disbursements for unapproved uses of FDA-approved drugs or drugs available under expanded access authorities (21 U.S.C. 360bbb–0a) (i.e., investigational drugs or devices for patients with serious diseases or conditions lacking satisfactory alternatives). The rule of construction provides that nothing in this section affects Federal laws, rules, regulations, or policies restricting abortion, assisted suicide, euthanasia, mercy killing, coercive family planning, female genital mutilation, or gender transition medical interventions.
