S. 1864 — No Safe Harbor for the Enemy Act

This section modifies public reporting requirements for Communist Chinese military companies operating in the United States (under Section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021) by establishing that the Secretary of Defense's decision to add an entity to the required public list is final and conclusive and may not be reviewed by any other official or court, including by mandamus. (Thus, judicial challenges to such list additions are prohibited.)
