§2.Innovative and emerging border technology plan
This section directs the Secretary of Homeland Security, acting through the U.S. Customs and Border Protection (CBP) Commissioner and the Under Secretary for Science and Technology and in consultation with the Chief Information Officer, Chief Procurement Officer, Privacy Officer, Officer for Civil Rights and Civil Liberties, General Counsel, and other relevant DHS offices, to submit to the Senate Committee on Homeland Security and Governmental Affairs and the House Committee on Homeland Security, no later than 180 days after enactment, a plan for identifying, integrating, and deploying new, innovative, disruptive, or other emerging or advanced safe and secure technologies to enhance CBP capabilities along international borders and at ports of entry.
The plan must include (1) information on CBP's use of CBP Innovation Teams and other mechanisms, including assessments of their contributions, team compositions, and coordination with acquisition and other partners; (2) identification of useful technologies from other federal agencies; (3) analyses of procurement authorities and any additional authorities needed; (4) plans to scale existing programs into programs of record and descriptions of planned security technology programs with objectives, goals, and timelines; (5) assessments of privacy, civil rights, civil liberties, and safety impacts with mitigation measures, and of legacy programs for phase-out and replacement with cost estimates; (6) details on coordination with DHS Science and Technology Directorate for research, development, private-sector incentives, and collaboration; (7) coordination with the DHS AI policy official for responsible AI use; (8) metrics for evaluating effectiveness; (9) identification of recent advancements in specified technologies (e.g., manned/unmanned aircraft systems, surveillance, nonintrusive inspection, tunnel detection, communications); and (10) coordination with specified DHS officers on research, development, acquisition, and scaling.
This section also authorizes the CBP Commissioner to maintain one or more CBP Innovation Teams to research and adapt new, innovative, disruptive, or other emerging commercial technologies.
