S. 1887 — Vote at Home Act of 2025

This section states 15 congressional findings supporting expanded vote-by-mail access, including that 35 states and the District of Columbia allow universal absentee voting (which no state has repealed); 8 states and the District of Columbia conduct all elections by mail; vote-by-mail reduced election costs by nearly 30% in Oregon (from $3.07 to $2.21 per voter) and 40% in Colorado; 20% of voters with disabilities faced in-person voting difficulties in 2022; and mail voting increases turnout without significant fraud risks.

This section adds new section 303A to the Help America Vote Act of 2002 (HAVA) requiring states, for federal elections in years beginning with 2026, to (1) mail ballots to all registered voters no later than two weeks before the election, (2) impose no additional eligibility conditions for mail voting beyond deadlines for requesting and returning ballots, and (3) ensure ballots are accessible to individuals with disabilities (without affecting polling place voting). It subjects these requirements to existing HAVA civil enforcement by the Attorney General (52 U.S.C. 21111) and makes conforming and clerical amendments. The section further adds new section 3407 to chapter 34 of title 39, United States Code, to provide free postage for ballots mailed to voters and by voters under HAVA section 303A, with related technical amendments and authorization of appropriations.

This section revises voter registration procedures through state motor vehicle driver's license applications under the National Voter Registration Act of 1993 (NVRA) (52 U.S.C. 20504). It streamlines the integrated voter registration form to require only minimum necessary information (i.e., to prevent duplicates, assess eligibility, and administer registration), a citizenship attestation under penalty of perjury treated as presumptive evidence of eligibility unless contradicted by reliable information of ineligibility, confidentiality protections for declinations or submissions, and transmission to election officials within 10 days (or 5 days near voter registration deadlines). It further requires motor vehicle authorities to automatically transmit minimum voter registration information for applicable individuals who have presented a citizenship document or are already registered, with election officials to determine current registration status, update addresses as needed, and assess eligibility (including via Help America Vote Act procedures).
