This section establishes liability protections, modeled on the Bill Emerson Good Samaritan Food Donation Act (which immunizes good faith donations of apparently wholesome food and apparently fit grocery products from civil or criminal liability except for gross negligence or intentional misconduct), for persons, nonprofit organizations, states, and units of local government that donate or distribute apparently fit pet-related products (i.e., pet food and pet supplies meeting all federal, state, and local quality and labeling standards despite not being readily marketable). Such protections apply to good faith donations for ultimate distribution to qualified animals (i.e., pets, emotional support animals, and service animals) and extend to partially noncompliant donations if the donor informs the recipient of defects, the recipient agrees to recondition the products to standards, and the recipient is knowledgeable in doing so. The section specifies that it does not create liability or supersede state or local health regulations.
