S. 2026 — Court Legal Access and Student Support Act of 2025

This section provides that chapter 1 of title 9, United States Code (relating to the enforcement of arbitration agreements), does not apply to enrollment agreements made between a student and an institution of higher education (as defined in 20 U.S.C. 1002). The term "enrollment agreement" means any contract or agreement under which the student makes a financial commitment to the institution in exchange for enrollment in a program of study.

This section establishes a new requirement (as para. (30)) in the program participation agreement for institutions of higher education to participate in federal student aid programs under Title IV of the Higher Education Act of 1965. The requirement prohibits an institution from requiring any student to agree to, or enforcing, any limitation or restriction—including on choice of applicable law, jury trial, or venue—on the student's ability to pursue a claim, individually or with others, against the institution in court.
