S. 2043 — Open America's Waters Act

This section repeals limitations on coastwise endorsements (i.e., documentation authorizing vessels to engage in domestic trade between U.S. ports), permitting issuance under revised 46 U.S.C. 12112(a) for any vessel qualifying under U.S. laws to participate in such trade. It directs the Coast Guard Commandant to issue implementing regulations within 90 days of enactment requiring all permitted vessels to meet applicable safety and security standards. It makes conforming amendments to title 46, U.S. Code—including repealing section 12132 (loss of coastwise trade privileges)—and striking related cross-references in provisions governing tank vessels, liquefied gas tankers, small passenger vessels, oil spill response vessels, regulatory measurement, and court sales of undocumented vessels.
