S. 2053 — A bill to ensure that Write Your Own companies can sell private flood insurance products that compete with National Flood Insurance Program products.

This section prohibits the FEMA Administrator from restricting Write Your Own Program (WYO Program) participants—or insurers, agents, brokers, or adjustment organizations providing services under the National Flood Insurance Program (NFIP)—from offering or selling private flood insurance (as defined in 42 U.S.C. 4012a(b)) as a condition of WYO or other NFIP participation. It further directs the Administrator, after enactment, not to include any such non-compete provisions in new WYO agreements. (As background, the WYO Program enables private insurers to market and service NFIP flood policies using their own brands and infrastructure.)
