S. 2068 — End Prescription Drug Ads Now Act

This section deems prescription drugs approved under section 505 of the Federal Food, Drug, and Cosmetic Act (FD&C Act) and prescription biologics licensed under section 351 of the Public Health Service Act misbranded if their sponsors have conducted direct-to-consumer advertising within the prior 30 days, thereby prohibiting such advertising (i.e., promotional communications targeting consumers via television, radio, print media, digital platforms, or social media). The prohibition takes effect 30 days after enactment and applies to all such drugs regardless of approval or licensure date.
