S. 2116 — A bill to require the Committee on Foreign Investment in the United States to annually review, update, and report on the facilities and property of the United States Government determined to be national security sensitive for purposes of review of real estate transactions under section 721 of the Defense Production Act of 1950.

This section amends section 721 of the Defense Production Act of 1950, governing reviews by the Committee on Foreign Investment in the United States (CFIUS) of real estate transactions near certain sensitive U.S. government facilities and property, to (1) authorize CFIUS to prescribe through regulations a list of such national security sensitive sites, which may include certain intelligence community facilities and National Laboratories (as defined in 42 U.S.C. 15801, i.e., 17 specified Department of Energy laboratories such as Los Alamos National Laboratory and Sandia National Laboratories); (2) require each CFIUS member agency, not later than January 31 each year, to review relevant facilities and property on the list and submit approved reports to the CFIUS chair with any recommended updates or revisions; and (3) expand CFIUS semiannual reports to Congress to include (a) a list of all notices, declarations, reviews, and investigations of covered transactions involving such sensitive sites and (b) a certification that the sensitive sites list reflects consideration of agency recommendations, with classified briefings on the list available upon request from specified congressional members.
