S. 2119 — Abducted Ukrainian Children Recovery and Accountability Act

This section states congressional findings recognizing a March 25, 2025, White House press release on the U.S. commitment to assist Ukraine with prisoner-of-war exchanges, civilian detainee releases, and the return of forcibly transferred Ukrainian children. It further finds that the U.S. government requires an organized and resourced policy approach to aid Ukraine in (1) investigating Russia's abduction of Ukrainian children, (2) rehabilitating and reintegrating returned children, and (3) pursuing justice and accountability for perpetrators.

This section authorizes the Departments of Justice, State, and Homeland Security to provide technical assistance, training, capacity building, and advisory support—including on biometric identification technologies for abduction and trafficking investigations, open-source intelligence collection and analysis, secure communications technologies, and database management—to the government of Ukraine in support of specified commitments and objectives. It requires those departments to coordinate with nongovernmental organizations (including via grants) and, through National Security Council-convened meetings involving the intelligence community, to implement such assistance. This section also prohibits the National Geospatial-Intelligence Agency from suspending or terminating Ukraine's access to the Global Enhanced GEOINT Delivery Program without notifying Congress at least 30 days in advance, including a justification and a plan for alternative access to U.S. satellite imagery.

This section authorizes the Secretary of State and the Administrator of the United States Agency for International Development to provide assistance to the government of Ukraine, nongovernmental organizations, and local civil society groups for Ukrainian children abducted by Russia, including (1) medical and psychological rehabilitation services, (2) family support services, and (3) reintegration services such as legal aid and educational screening and placement. This section also requires the Secretary of State to submit to the Senate Committee on Foreign Relations and the House Committee on Foreign Affairs, within 60 days of enactment, a report describing all current or planned foreign assistance programs providing such assistance.

This section authorizes (1) the Department of State, under the Ambassador at Large for Global Criminal Justice, to support the Atrocity Crimes Advisory Group for Ukraine by providing technical assistance, capacity building, and advisory support to Ukraine’s Office of the Prosecutor General and other relevant components for investigating and prosecuting cases involving abducted children and other war crimes; and (2) the Department of Justice to provide similar support through its Office of Overseas Prosecutorial Development, Assistance, and Training, coordinated by the Resident Legal Adviser at the U.S. Embassy in Kyiv, for investigating and prosecuting cases involving abducted children and other atrocity crimes. It further directs (1) the Secretary of State, in coordination with the Attorney General, to submit a report within 60 days of enactment to the Senate Committees on Foreign Relations and the Judiciary and the House Committees on Foreign Affairs and the Judiciary describing current and planned U.S. government support for Ukraine’s war crimes investigations and prosecutions; and (2) the Secretary of State, in coordination with the Secretary of the Treasury, to submit a report within 60 days of enactment to the Senate Committees on Foreign Relations and Banking, Housing, and Urban Affairs and the House Committees on Foreign Affairs and Financial Services outlining discrepancies between U.S., U.K., and EU sanctions regimes regarding those responsible for abducting Ukrainian children and U.S. efforts to align such regimes.

This section authorizes the President to utilize any Russian sovereign assets held in the United States for purposes described in this Act and in accordance with the Rebuilding Economic Prosperity and Opportunity for Ukrainians Act (division F of Public Law 118–50).
