S. 212 — POLICE Act of 2025

This section establishes a new ground of deportability under the Immigration and Nationality Act for any alien convicted of, who admits having committed, or who admits committing acts that constitute the essential elements of an offense involving assault of a law enforcement officer. The assault must occur (1) while the officer is engaged in official duties, (2) because of the performance of such duties, or (3) because of the officer's status as a law enforcement officer (i.e., any person authorized to prevent, detect, investigate, prosecute, or incarcerate for criminal violations of law; to apprehend, arrest, or prosecute for such violations; or to serve as a firefighter or other first responder), with "assault" defined by the law of the jurisdiction where the act occurred.

This section directs the Secretary of Homeland Security to submit to Congress, and make publicly available on the Department of Homeland Security website, an annual report identifying the number of aliens deported during the previous fiscal year pursuant to INA §237(a)(2)(G) (8 U.S.C. 1227(a)(2)(G)) (i.e., for assault of a law enforcement officer).
