This section revises the Department of Defense's buy-to-budget authority under 10 U.S.C. 3069 to acquire a higher quantity of an end item than specified in a funding law using available funds by (1) eliminating the requirement to make four specified findings (i.e., established need, production efficiencies, no excess spending, and full unit funding); (2) striking the requirements for regulations, congressional notification (previously required within 30 days except for tactical missiles or munitions), and preclusion of waivers by other laws; and (3) redesignating the definitions subsection—specifying when a quantity is considered set in law, including via tables or explanatory text in joint explanatory statements or committee reports—as subsection (b). (Thus, the authority becomes unconditional subject only to available funds.)
