This section directs the Federal Trade Commission (FTC), not later than one year after enactment, to promulgate rules prohibiting manufacturers, dealers, importers, or their agents from marketing or advertising firearms or firearm-related products to minors in a manner designed, intended, or reasonably appearing attractive to minors, based on the totality of circumstances including (1) use of cartoon characters, caricatures, or memes appealing to minors; (2) offers of branded merchandise (e.g., hats, T-shirts, toys) to minors; (3) products with features, sizes, or designs appealing to minors; (4) depictions of minors using firearms; (5) targeting predominantly minors; (6) gifts of such products to minors; or (7) promotion of federal government or military contracts. This section treats violations as unfair or deceptive acts or practices under FTC Act section 18(a)(1)(B) (15 U.S.C. 57a(a)(1)(B)), enforceable by the FTC using its existing authorities; authorizes state attorneys general to bring civil actions on behalf of state residents for injunctive relief, damages, or other remedies (with prior notice to the FTC and FTC intervention rights, except in exigent circumstances); limits state actions during pending FTC enforcement against the same defendant for the same violation; and establishes a private right of action.
