S. 217 — Apex Project, Nevada Land Transfer and Authorization Act Amendments Act

This section amends the Apex Project, Nevada Land Transfer and Authorization Act of 1989 to (1) revise the definitions section by adding terms for "Apex Industrial Park Owners Association" (formed April 9, 2001, in Nevada, including successors) and "City" (city of North Las Vegas, Nevada), redesignating paragraphs, and improving formatting and headings; (2) expand eligibility for the Kerr-McGee site transfer and other land conveyances under section 3(b) to include Clark County, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate (previously limited to Clark County); (3) broaden eligibility for additional land transfers under section 4(c) to the same entities (previously Clark County) and authorize the Secretary to sell mineral materials from grading, land balancing, or other surface activities on parcels within the Apex site where the United States retains mineral interests, at fair market value without advertising, bids, or volume/time limitations notwithstanding 43 CFR part 3600; and (4) require each land transfer or right-of-way issuance within the Apex site to comply with applicable federal laws, including NEPA and FLPMA. (The 1989 act authorizes conveyance of federal lands in Clark County, Nevada, for industrial development at the Apex site, including remediation of a contaminated former Kerr-McGee chemical facility.)
