This section prohibits U.S. assistance to any foreign country that (1) opposed the U.S. position in the United Nations (i.e., voted with the U.S. less than 50% of the time on recorded votes in the most recent General Assembly session, and Security Council votes if applicable, per the annual report required under 22 U.S.C. 2414a); or (2) sponsors or leads resolutions disproportionately targeting the U.S. or its allies. U.S. assistance includes the Economic Support Fund (22 U.S.C. 2346 et seq.), international military education and training (22 U.S.C. 2347 et seq.), Foreign Military Financing Program (22 U.S.C. 2763), and any other direct or indirect monetary or physical assistance, including through international organizations, multilateral institutions, or nongovernmental entities (e.g., U.N. programs). The Secretary of State may exempt a country from the prohibition if there has been a fundamental change in its government leadership and policies resulting in alignment with U.S. positions, with the exemption effective only until the next annual report under 22 U.S.C. 2414a and requiring congressional notification with a discussion of the basis for the determination. (As background, 22 U.S.C. 2414a requires the Secretary of State to submit an annual report by March 31 assessing U.N. member countries' voting practices against U.S. policy priorities, including country-by-country comparisons of General Assembly votes.) The prohibition takes effect upon submission of the report due by March 31, 2026.
