S. 2171 — A bill to amend title 38, United States Code, to prohibit smoking on the premises of any facility of the Veterans Health Administration, and for other purposes.

This section revises 38 U.S.C. 1715—previously authorizing the Secretary of Veterans Affairs to furnish tobacco to veterans receiving hospital or domiciliary care—to prohibit any person (including veterans, patients, employees, contractors, or visitors) from smoking on the premises of any Veterans Health Administration (VHA) facility. It defines VHA facility as any land or building (e.g., medical center, nursing home, outpatient clinic, or readjustment counseling center) under Department of Veterans Affairs jurisdiction and VHA control (not General Services Administration) and smoke to include combustion or heating of tobacco or use of electronic nicotine delivery systems (e.g., e-cigarettes, vape pens). The section also repeals a conforming amendment from the Veterans Health Care Act of 1992 (P.L. 102-585) and updates the table of sections for chapter 17 of title 38, United States Code.
