S. 2172 — Respectful Treatment of Unborn Remains Act of 2025

This section prohibits an abortion provider (i.e., an individual who performs an abortion, excluding the pregnant individual) from causing fetal remains (i.e., remains of an aborted fetus or portion thereof, or associated medical waste) to be placed into a publicly owned water system (i.e., government-owned facilities for providing, transporting, or treating water, including connected drains and pipes). It imposes penalties for violations including fines under 18 U.S.C., imprisonment for up to five years, or both; exempts the pregnant individual from liability; and specifies that the prohibition does not preempt stricter state or local requirements.
