S. 22 — SWAMP Act

This section prohibits the headquarters of an executive agency—defined as an executive department, government corporation, or independent establishment under 5 U.S.C. §105, excluding the Executive Office of the President; Department of Defense (including the Defense Intelligence Agency, National Security Agency, and National Geospatial-Intelligence Agency); Department of Energy; Department of Homeland Security; Department of State; Office of the Director of National Intelligence; and Central Intelligence Agency—from being located in the Washington metropolitan area (i.e., the District of Columbia; Montgomery and Prince George's Counties, Maryland; and Arlington, Fairfax, Loudoun, Prince William Counties and Alexandria, Virginia), except for those located there on the date of enactment. Such existing headquarters may remain subject to post-enactment restrictions prohibiting new construction or major renovations, lease renewals, or new leases unless expressly authorized by law. This section further requires the Administrator of General Services, not later than one year after enactment, to establish a competitive bidding process—open to proposals from any state or political subdivision, with public notice and comment—for agency heads to request or the Administrator to initiate solicitation of relocation sites, selecting based on economic and workforce impacts, relevant expertise, and national security considerations. Proceeds from federal building or land sales may offset relocation costs, and implementation must use existing funds with no additional amounts authorized.
