S. 2202 — Intelligence Community Efficiency and Effectiveness Act of 2025

This section designates the Act as the "Intelligence Community Efficiency and Effectiveness Act of 2025" and sets forth its table of contents.

This section modifies the responsibilities and authorities of the Director of National Intelligence (DNI) under section 102A of the National Security Act of 1947 (50 U.S.C. 3024) by— (1) repealing requirements for semi-annual reports (subsection (c)(7)), annual reports on other transaction authority (subsection (n)(6)(E)), enhanced personnel management (subsection (l)), personnel transfers to new national intelligence centers (subsection (e)), and DNI authority to oversee or establish national intelligence centers and prescribe their personnel policies (subsection (f)(2)-(3)); (2) revising tasking authorities in subsection (f)—as redesignated—to replace "conduct" with "direct" for accountability reviews and "conduct" or "carry out" with "direct independent" for insider threat and counterintelligence assessments, while striking references to Central Intelligence Agency supervision; (3) authorizing the DNI to delegate to heads of intelligence community elements the review and investigation of proposed investments into the United States (subsection (z)); (4) requiring the DNI, not later than 180 days after enactment and in consultation with intelligence community heads, to submit to the congressional intelligence committees a plan—with an itemization of major planned or pending acquisitions for each element—to reform intelligence community acquisition processes to expedite acquisitions and prioritize commercial solutions consistent with 10 U.S.C. § 3453 (requiring, to the maximum extent practicable, preference for commercial products and services or nondevelopmental items in defense procurement) and Executive Order 14265 (relating to modernizing defense acquisitions); and (5) making conforming amendments, including redesignating subsections (f)-(k) as (e)-(j) and (m)-(z) as (k)-(x), and updating cross-references in that section and related statutes.

This section revises the composition of the Office of the Director of National Intelligence (ODNI) by removing from it any Deputy Director of National Intelligence (other than the Principal Deputy), the Director of the National Counterintelligence and Security Center, the Director of the National Counterterrorism Center, the Director of the National Counter Proliferation Center, and any reference to national intelligence centers. (1) It limits ODNI staff to 650 full-time equivalent employees and detailees employed by, assigned to, under contract with, serving, or otherwise affiliated with the office (excluding service in a national intelligence task force under section 119B); and (2) it requires ODNI facilities necessary to carry out the core intelligence mission of the office.

This section redesignates the Principal Deputy Director of National Intelligence as the Deputy Director of National Intelligence; eliminates the positions of Deputy Directors of National Intelligence; and establishes, as appointed by the Director of National Intelligence, an Assistant Director of National Intelligence for Mission Integration and an Assistant Director of National Intelligence for Policy and Capabilities. (Thus, these positions support the Director of National Intelligence in overseeing the Intelligence Community's 18 elements.) The section makes conforming amendments to headings, text, and the table of contents in the National Security Act of 1947 (50 U.S.C. 3024 et seq.) and other laws and provides that statutory references to the Principal Deputy Director of National Intelligence are treated as references to the Deputy Director of National Intelligence.

This section revises duties of the National Intelligence Council (NIC) by (1) changing its role in subparagraph (c)(1)(A) from producing national intelligence estimates to coordinating their production and (2) narrowing its evaluation duty in subparagraph (c)(1)(B) to community-wide collection and production of intelligence, excluding previously required consideration of requirements and resources. (The NIC produces national intelligence estimates for the U.S. government, including alternative views; evaluates intelligence collection and production; and assists the Director of National Intelligence.) It further makes staff availability for the NIC in subsection (f) subject to section 103(d)(1) (from unconditional). The section also directs the Director of National Intelligence to transfer all functions, duties, and responsibilities of National Intelligence Managers—as in effect the day before enactment—to National Intelligence Officers and to terminate the National Intelligence Manager position.

This section transfers the National Counterintelligence and Security Center—including its staff, resources, and the duties of its director—from the Office of the Director of National Intelligence to the Counterintelligence Division of the Federal Bureau of Investigation, with the FBI Assistant Director for Counterintelligence (or designee) serving as head of the center. (As background, the center coordinates U.S. counterintelligence efforts across the intelligence community to counter foreign intelligence threats.) The section (1) repeals the statutory provision establishing the center under the Director of National Intelligence (50 U.S.C. 3031); (2) strikes the Director of the center from Executive Schedule Level IV (5 U.S.C. 5315); and (3) makes conforming amendments to the Counterintelligence Enhancement Act of 2002 (50 U.S.C. 3382, 3383) and other laws to reflect the transfer and new leadership.

This section redesignates the National Counterterrorism Center (NCTC) as the National Counterterrorism and Counternarcotics Center throughout federal law and makes conforming amendments in the National Security Act of 1947, Homeland Security Act of 2002, Intelligence Reform and Terrorism Prevention Act of 2004, and other statutes. It (1) eliminates the requirement for Senate confirmation of the director; (2) revises primary missions under section 119(d) of the National Security Act of 1947 (50 U.S.C. 3056(d)) by striking paragraphs (2) and (3) and redesignating paragraphs (4) through (6) as paragraphs (2) through (4); (3) transfers counterterrorism strategic operational planning duties—integrating all instruments of national power and assigning agency roles and responsibilities without directing operations—to the National Security Council under section 101(b) (50 U.S.C. 3021(b)); (4) authorizes the center, consistent with applicable law, to receive and retain intelligence on domestic terrorism (as defined in 18 U.S.C. § 2331(5)) solely to support its functions of collecting, retaining, and disseminating intelligence on international terrorism (as defined in 18 U.S.C. § 2331(1)); (5) revises director duties under section 119(f), including striking certain responsibilities, limiting foreign information dissemination to DNI-approved coordination, and making conforming redesignations; and (6) repeals the requirement for a Directorate of Strategic Operational Planning. (As background, NCTC coordinates counterterrorism analysis, planning, and information sharing across the intelligence community, federal agencies, and state, local, and tribal governments.) The amendments take effect 30 days after enactment.

This section transfers the National Counterproliferation and Biosecurity Center from the Office of the Director of National Intelligence to the Central Intelligence Agency (CIA), including appropriate missions, objectives, staff, and resources as determined by the Director of National Intelligence in coordination with the CIA Director, effective 180 days after enactment. (As background, the center integrates U.S. government intelligence on weapons of mass destruction proliferation, delivery systems, related materials and technologies, biosecurity, and foreign biological threats.) It further (1) redesignates the center as the National Counterproliferation Center and narrows its missions by striking all biosecurity functions and objectives; (2) changes the head from a Director appointed by the Director of National Intelligence to the CIA Director or designee and eliminates the center director's role as principal coordinator and advisor to the Director of National Intelligence on these matters; (3) repeals the President's national security waiver authority, reporting requirements to Congress, and sense-of-Congress provision; and (4) updates statutory references and the table of contents accordingly. (Thus, the center will focus solely on counterproliferation intelligence integration, access, repositories, dissemination, assessments, and planning.)

This section revises section 119B of the National Security Act of 1947 by replacing the authority to establish ongoing national intelligence centers—with primary responsibility for all-source analysis, intelligence requirements proposals, dedicated personnel and budgets, and regular reviews—with authority for the Director of National Intelligence to convene temporary national intelligence task forces to address specific intelligence priorities. Task forces may (1) comprise select employees from intelligence community elements other than the Office of the Director of National Intelligence, (2) convene at that Office for limited periods in support of a specific intelligence matter, and (3) be dissolved not later than 540 days after concluding support for that matter. Employees retain compensation from their home agencies. For task forces in effect more than 60 days, the Director must notify congressional intelligence committees by day 61 regarding participating personnel numbers and employing elements, the specific intelligence matter, and approximate dissolution date. This section also makes a clerical amendment to the Act's table of contents.

This section repeals statutory authority for, and directs termination of, four intelligence community entities: (1) the Intelligence Community Chief Data Officer (i.e., position responsible for data strategy and management across the intelligence community); (2) the Intelligence Community Innovation Unit (effective 90 days after enactment); (3) the Foreign Malign Influence Center (effective 90 days after enactment, with conforming amendments redefining "foreign malign influence" and "covered foreign country" to include the governments or military/intelligence-affiliated entities of China, Russia, North Korea, Iran, or others as designated by the Director of National Intelligence); and (4) the Climate Security Advisory Council (with conforming amendment relocating the definition of "climate security"—i.e., effects of climate change on U.S. national security, political stability, allies, and political violence—to specified National Defense Authorization Act provisions).

This section establishes a prohibition on obligating or expending National Intelligence Program funds to provide financial or in-kind support to covered entities—including those organized for research or advocacy (e.g., public policy or political strategy) or describing themselves as think tanks—for analytic collaboration, including studies, research, or assessments, if such entities have received or expect to receive support from foreign governments other than Five Eyes alliance members (i.e., Australia, Canada, New Zealand, United Kingdom, and United States). This section subjects the National Intelligence Council's (NIC) authority to contract for such purposes to this prohibition (to subject to the direction and control of the Director of National Intelligence and new sec. 314 (from subject to the direction and control of the Director of National Intelligence)) and makes conforming changes to the table of contents. (As background, the NIC produces national intelligence estimates and assists the Director of National Intelligence.)

This section establishes a limitation prohibiting the use of appropriated intelligence community funds for any facility or property used, owned, leased, or operated by the Office of the Director of National Intelligence (ODNI)—or otherwise functioning for ODNI's benefit—that the Director of the Office of Management and Budget (OMB) determines is not necessary to carry out the National Security Act of 1947, effective one year after enactment. The limitation does not apply to activities furthering the sale or divestment of such facilities, in which case ODNI must (1) sell the facility at not less than fair market value as determined by OMB or (2) divest in a manner approved by OMB; the limitation also applies to facilities and property of the National Intelligence University (i.e., the primary education and training institution for the intelligence community). (Thus, OMB determinations will identify excess ODNI real property ineligible for ongoing funding, requiring disposition to avoid funding restrictions.)

This section directs the Director of National Intelligence to wind down and terminate the National Intelligence University no later than 180 days after the date of enactment. (As background, the National Intelligence University provides advanced education and training in intelligence to personnel of the intelligence community and Department of Defense.) It further (1) repeals subtitle D of title X of the National Security Act of 1947, which established the university; (2) strikes conforming provisions in 10 U.S.C. §2151(b)(3), 17 U.S.C. §105(d)(2)(M), and section 5324 of Public Law 116-92; and (3) updates the table of contents for the National Security Act of 1947.

This section defines "diversity, equity, or inclusion practice" to include discrimination based on race, color, ethnicity, religion, biological sex, or national origin; mandatory training or coursework asserting inherent or systemic superiority, inferiority, oppression, or privilege based on those characteristics; or required assent to statements asserting such concepts. It prohibits the obligation or expenditure of National Intelligence Program (NIP) funds—i.e., the primary funding source for the intelligence community (IC), which collects foreign intelligence and counterintelligence—for any such practice in the IC. It further directs the Director of National Intelligence, in coordination with IC element heads, to immediately commence revising all IC regulations, policies, procedures, manuals, circulars, courses, training, and guidance for compliance and to rescind any materials promoting such practices.
