S. 2268 — Agricultural Risk Review Act of 2025

This section designates the Secretary of Agriculture as a member of the Committee on Foreign Investment in the United States (CFIUS) with respect to covered transactions involving (1) agricultural land, (2) agricultural biotechnology, or (3) the agriculture industry, including agricultural transportation, storage, and processing. (CFIUS reviews foreign mergers, acquisitions, takeovers, and certain other investments in the United States for national security risks.)

This section requires the Committee on Foreign Investment in the United States (CFIUS), upon notification from the Secretary of Agriculture of a reportable agricultural land transaction, to determine whether the transaction is a covered transaction and, if so, whether to initiate a review or take other authorized action. A reportable agricultural land transaction is (1) one the Secretary has reason to believe is a covered transaction, based on information from or in cooperation with the intelligence community; (2) involving acquisition of an interest in U.S. agricultural land by a foreign person of China, North Korea, Russia, or Iran; and (3) requiring a report to the Secretary under the Agricultural Foreign Investment Disclosure Act of 1978. These requirements sunset for foreign persons of a specified country upon that country's removal from the list of foreign adversaries at 15 CFR 791.4. (As background, CFIUS reviews foreign investments, including certain U.S. real estate transactions near ports or military installations, for national security risks; this provision leverages mandatory disclosures of foreign agricultural land purchases to flag potential covered transactions by designated adversaries.)
