S. 2291 — Flex Fuel Fairness Act of 2025

This section states a congressional finding that the Greenhouse gases, Regulated Emissions, and Energy use in Technologies (GREET) model developed by Argonne National Laboratory shows E85 fuel made with average corn starch ethanol reduces greenhouse gas emissions by 37% per mile traveled compared to gasoline with no ethanol.

This section establishes definitions for purposes of this Act, including (1) Administrator as the Administrator of the Environmental Protection Agency; (2) flexible fuel vehicle as that term is defined in 40 CFR 86.1803-01 (as in effect on the date of enactment); and (3) manufacturer as that term is defined in section 216 of the Clean Air Act (42 U.S.C. 7550) (i.e., any person engaged in the manufacturing or assembling of new motor vehicles, new motor vehicle engines, new nonroad vehicles or new nonroad engines, or importing such vehicles or engines for resale).

This section directs the EPA Administrator, not later than 120 days after enactment, to revise regulations on fleet average CO2 standards for light-duty vehicles (40 C.F.R. § 86.1818-12) to allow manufacturers to use a gram per mile CO2 value for flexible fuel vehicles (FFVs, i.e., vehicles capable of operating on gasoline or E85) that is 31% lower than for the same make and model that is not an FFV. The Administrator may apply a larger percentage reduction based on a post-enactment version of the Greenhouse gases, Regulated Emissions, and Energy use in Technologies (GREET) model developed by Argonne National Laboratory.
