S. 230 — Unborn Child Support Act

This section amends state plan requirements under the Child Support Enforcement Program (Title IV-D of the Social Security Act) to (1) extend enforcement of child support obligations to biological fathers of unborn children (defined as a member of the species homo sapiens at any stage of development carried in the womb); and (2) require states to establish and enforce such obligations upon the mother's request, with a potential start date from the first month of conception (as determined by a physician), eligibility for retroactive collection (including post-birth paternity establishment), court-determined payment amounts considering the best interests of the mother and child, and no paternity measures without maternal consent or if posing risk of harm to the unborn child. It further limits the Secretary's waiver authority under Section 1115 by prohibiting experimental, pilot, or demonstration projects that modify these new requirements. (Thus, states may not use waivers to avoid enforcing child support for unborn children.) The amendments take effect two years after enactment and apply to program payments for calendar quarters beginning on or after that date.
