This section establishes definitions and restrictions on donations to presidential libraries and centers (i.e., organizations raising funds for presidential archival depositories subject to the Presidential Records Act, related facilities, or affiliated private museums, foundations, or centers established after a president's first campaign). As background, presidential libraries are privately funded facilities that house and exhibit presidential records and artifacts before transferring ownership to the National Archives and Records Administration. The section prohibits, while an individual is serving or elected as president, a presidential library or center, its officers or employees, or the Archivist from soliciting or accepting donations from any person that (1) is not a 501(c)(3) tax-exempt organization or (2) is a registered lobbyist (under the Lobbying Disclosure Act of 1995), registered agent of a foreign principal (under the Foreign Agents Registration Act), federal contractor, foreign national (under the Federal Election Campaign Act), or seeking or has received a pardon from that president; it similarly prohibits such persons from making donations. For the two-year period after the president leaves office, the section imposes the same prohibitions on donations from registered lobbyists, registered agents of a foreign principal, federal contractors, foreign nationals, or pardon seekers or recipients.
