S. 2320 — Compressed Gas Cylinder Safety and Oversight Improvements Act of 2025

This section establishes requirements for the Department of Transportation (DOT) to approve foreign manufacturers of cylinders (FMOCs)—entities outside the United States producing cylinders certified under DOT regulations (49 CFR 178.36–178.68) for transporting hazardous materials in U.S. commerce. Specifically, it directs the Secretary of Transportation to promulgate regulations providing for FMOC approvals of not longer than 1 year under 49 CFR 107.807 (or successor), with an exception for 5-year approvals if the FMOC (1) attests that none of its cylinders are prohibited from U.S. entry under the forced labor ban (19 U.S.C. 1307), (2) certifies the accuracy of application information and commits to reporting material changes, and (3) is in good standing (i.e., DOT-approved with 3 years of compliance under 49 CFR part 107 and 49 U.S.C. chapter 51). It authorizes suspension or termination of approvals for obstructing inspections, knowing misrepresentations, or other cause. It further (1) requires regulations within 180 days of enactment for interested parties to petition for FMOC approval reevaluation based on evidence of inaccurate, changed, or fraudulent attestations; (2) mandates public notice of applications on the Pipeline and Hazardous Materials Safety Administration website with 30 days for comment prior to approval; and (3) requires FMOC applications to disclose whether the applicant or any entity controlling more than 10% has faced civil or criminal penalties under specified laws, delinquent payments, inclusion on the Do Not Pay list (31 U.S.C. 3354), the Commerce Department's Military End User List, or the Department of Defense's section 1237 list (50 U.S.C. 1701 note).
