S. 2329 — Medicare Orthotics and Prosthetics Patient-Centered Care Act

This section amends Medicare payment rules for durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) to increase protections for beneficiaries receiving orthotic and prosthetic care, as follows: (1) prohibits payment under Medicare Part B for orthotics and prosthetics (excluding supplies, as identified by HCPCS codes not subject to competitive acquisition under section 1847) furnished via drop shipment—defined as direct shipment to the beneficiary without training on fitting, adjustment, care, and use from a qualified practitioner—beginning on the first day of the first year after enactment; (2) expands the practitioners exempt from competitive acquisition requirements to include physical therapists, occupational therapists, orthotists, and prosthetists (in addition to physicians); (3) extends the existing replacement payment allowance for prosthetic devices (artificial limbs) to also cover replacement of custom-fitted orthotics and custom-fabricated orthotics; and (4) directs the Secretary of Health and Human Services to promulgate final implementing regulations within one year of enactment.
