S. 2346 — Preparing Election Administrators for AI Act

This section directs the Election Assistance Commission (EAC), in consultation with the National Institute of Standards and Technology (NIST), to submit to Congress, issue to state and local election offices, and make publicly available a report with voluntary guidelines on the use and risks of artificial intelligence (AI) technologies in election administration within 60 days of enactment. The guidelines address (1) risks and benefits of using AI for election administration activities; (2) cybersecurity risks of AI to election administration; (3) effects of AI-generated information on sharing accurate election information and appropriate responses; and (4) effects of AI-generated information on spreading election disinformation that undermines public trust and confidence in elections.

This section directs the Election Assistance Commission (EAC), in consultation with the National Institute of Standards and Technology, to study the use and impacts of artificial intelligence technologies in the 2024 federal elections—including dissemination of AI-generated information and AI use by election offices—and to submit a report to Congress, issue it to state and local election offices, and make it publicly available by July 31, 2026. The section further requires the EAC to review and update, as appropriate, the voluntary guidelines issued under section 2(a) based on the study's results.
