S. 2350 — Protect DREAMer Confidentiality Act of 2025

This section defines, for purposes of the Act, the terms “DACA program” (i.e., the Deferred Action for Childhood Arrivals program as described in specified DHS regulations, a 2022 final rule [87 Fed. Reg. 53152], and a 2012 DHS memorandum), “individual application information” (i.e., any information, including personally identifiable information, submitted to DHS after June 15, 2012, for DACA consideration or reconsideration), and “Secretary” (i.e., the Secretary of Homeland Security).

This section requires the Secretary of Homeland Security to protect confidentiality of individual DACA (Deferred Action for Childhood Arrivals) application information by prohibiting its disclosure to U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), or any state, local, or Tribal law enforcement agency except for DACA program implementation. The section further prohibits referrals of deferred DACA cases to ICE, CBP, the Department of Justice, or any other law enforcement agency, with limited exceptions allowing information sharing to (1) identify or prevent fraudulent claims, (2) address particularized national security purposes for an individual application, or (3) investigate or prosecute felonies unrelated to immigration status.
