This section defines the term "anarchist jurisdiction" as a State or unit of local government that has refused to take reasonable steps to stop acts of violence and destruction of property in its jurisdiction.
This section directs the Attorney General, in consultation with the Secretary of Homeland Security and the Director of the Office of Management and Budget, to publish on the Department of Justice website, not later than 14 days after enactment, a list identifying each anarchist jurisdiction (i.e., a state or unit of local government) and to update the list at least every 180 days thereafter. In identifying such jurisdictions, the Attorney General must consider, as appropriate, whether they (1) have policies or practices preventing or restricting law enforcement intervention to restore order amid widespread or sustained violence or destruction; (2) have prevented law enforcement from policing areas or structures they are lawfully entitled to police, except for tactical decisions to temporarily withhold officers during imminent threats; (3) have disempowered or defunded law enforcement; or (4) unreasonably refuse federal law enforcement assistance. This section further directs the Director of the Office of Management and Budget to issue guidance, not later than 30 days after enactment, to federal agency heads on restricting eligibility for, or otherwise disfavoring to the maximum extent permitted by law, anarchist jurisdictions in receiving federal grants where agencies have sufficient discretion to do so. (Thus, identified jurisdictions may receive reduced or no federal grant funding from applicable programs.)
