S. 240 — Crow Tribe Water Rights Settlement Amendments Act of 2025

This section amends the Crow Tribe Water Rights Settlement Act of 2010 (P.L. 111-291) as follows: (1) revises definitions in Section 403 to redefine "MR&I Project" as activities specified in Section 411(e)(3)(F) (i.e., planning, design, construction, etc., of water infrastructure) and replaces references to "MR&I System" with "MR&I Projects" in the definition of Crow Water Supply Projects; (2) repeals Section 406, which authorized an MR&I System for the Crow Tribe; (3) amends Section 411, governing the Crow Settlement Fund, to modify fund management and availability, update cross-references, add an MR&I Projects Account for tribal water production, treatment, delivery, wastewater infrastructure, environmental compliance, and (after notice) on-reservation land purchases with water rights, and clarify that title to and operation of such projects remain with the Tribe while the federal government has no operation, maintenance, or replacement obligation; (4) redesignates Sections 412-416 as 413-417 and inserts new Section 412 to establish the Crow CIP Implementation Account (i.e., nontrust, interest-bearing account) for capital improvement projects under Section 405, with deposits from specified appropriations and earnings available for those uses; (5) in redesignated Section 413(b)(1), extends the Yellowtail Dam mitigation period in Montana to 20 years (from 15 years); and (6) amends redesignated Section 415 to replace "MR&I System" with "MR&I Projects" and revise subsection (h) to authorize joint signature accounts for fund withdrawals.
