S. 2431 — Department of the Interior, Environment, and Related Agencies Appropriations Act, 2026

This section authorizes intra-bureau transfers of appropriations in this title, with Secretary of the Interior approval and notwithstanding section 129 restrictions, for emergency reconstruction, replacement, or repair of aircraft, buildings, utilities, or other facilities or equipment damaged or destroyed by fire, flood, storm, or other unavoidable causes. Such transfers are available only after exhausting funds specifically appropriated to the Department of the Interior for emergencies, and all funds used must be replenished by a supplemental appropriation requested as promptly as possible.

This section expands department-wide emergency transfer authority for the Secretary of the Interior—available from any no-year appropriations notwithstanding section 129 of this title—to include the prevention, suppression, and control of actual or potential grasshopper and Mormon cricket outbreaks on lands under the department's jurisdiction, pursuant to 7 U.S.C. 7717(b). (As background, 7 U.S.C. 7717 directs USDA to carry out grasshopper and Mormon cricket control on all federal lands to protect rangeland—including 100% federal cost share on federal lands, 50% on state lands, and transfers from Interior no-year funds to USDA upon request after USDA's specific appropriations are exhausted—with replenishment required; thus, this provision enables Interior to directly fund such activities on its lands using emergency authority, subject to pro rata replenishment by supplemental appropriation.)

This section authorizes Department of the Interior appropriations for services as authorized by 5 U.S.C. 3109 (i.e., temporary or intermittent expert and consultant services procured by contract, without regard to competitive service appointment rules or certain pay limits), when approved by the Secretary, not to exceed $500,000 total; purchase and replacement of motor vehicles, including specially equipped law enforcement vehicles; hire, maintenance, and operation of aircraft; hire of passenger motor vehicles; purchase of reprints; telephone service payments in private residences in the field when authorized under Secretary-approved regulations; and dues payments for library memberships in societies or associations offering publications to members only or at discounted member rates, when authorized by the Secretary.

This section authorizes appropriations in this Act under the headings "Bureau of Indian Affairs and Bureau of Indian Education" and "Bureau of Trust Funds Administration"—including any unobligated balances from prior appropriations Acts—for expenditure or transfer for Indian trust management and reform activities (i.e., Department of the Interior efforts to improve the management of lands, natural resources, and funds held in trust for tribes and individual Indians). Total funding for settlement support activities may not exceed amounts specifically designated in this Act for such purpose, and the Secretary must notify the House and Senate Committees on Appropriations within 60 days of any such expenditure or transfer, including the amount and intended use.

This section authorizes the Secretary of the Interior to redistribute Bureau of Indian Affairs Tribal Priority Allocation (TPA) funds—including tribal base funds—notwithstanding other laws, to alleviate tribal funding inequities by addressing identified unmet needs, dual enrollment, overlapping service areas, or inaccurate distribution methodologies. No tribe may receive a TPA funds reduction exceeding 10% in FY2026, except in cases of dual enrollment, overlapping service areas, or inaccurate distribution methodologies.

This section authorizes the Secretary of the Interior to acquire lands, waters, or interests therein—including piers, docks, or landings in New York and New Jersey—by donation, appropriated funds (including franchise fees), or exchange, and to enter into leases, subleases, concession contracts, or other agreements, for facilities supporting transportation, visitor accommodations, and other activities at Ellis, Governors, and Liberty Islands. For purposes of Land and Water Conservation Fund (LWCF) acquisitions under 54 U.S.C. 200306(a)(2)(A)—which provides funds for land, water, or interests within the exterior boundaries of National Park System units—such properties are deemed to be within the exterior boundary of a System unit authorized or established.

This section establishes nonrefundable inspection fees for FY2026, to be collected by the Secretary of the Interior from designated operators of outer Continental Shelf (OCS) facilities subject to annual and periodic onsite inspections under 43 U.S.C. 1348(c) (i.e., inspections to ensure compliance with OCS safety and environmental regulations), with fees deposited into the Offshore Safety and Environmental Enforcement account. The section sets annual fees for waterline facilities (excluding drilling rigs) in place at the start of FY2026 as follows: (1) $10,500 for facilities with no wells but with processing equipment or gathering lines; (2) $17,000 for facilities with 1-10 wells; and (3) $31,500 for facilities with more than 10 wells. It further requires per-inspection fees in FY2026 of (1) $30,500 for drilling rigs in water depths of 500 feet or more and $16,700 for those in water depths of less than 500 feet; and (2) for non-rig well operations (per 30 C.F.R. pt. 250, subpts. D, E, F, and Q), $13,260 per inspection in water depths of 2,500 feet or more, $11,530 in depths of 500-2,499 feet, and $4,470 in depths of less than 500 feet. The section directs quarterly billing for annual fees (with payment due within 30 days), billing within 30 days after drilling rig inspections (payment due within 30 days), and billing for non-rig units with payment due by the end of the following quarter.

This section authorizes the Secretary of the Interior to enter into multiyear cooperative agreements with nonprofit organizations and other entities, and multiyear contracts under 41 U.S.C. 3903 (except exempting the 5-year term limit of subsection (a)), for long-term care and maintenance of excess wild free-roaming horses and burros on private land, notwithstanding other provisions of the Act. Such agreements and contracts may not exceed 10 years (from 5 years), subject to renewal at the Secretary's discretion.

This section directs the U.S. Fish and Wildlife Service to implement a mass marking system for salmonid stocks (including but not limited to coho, chinook, and steelhead) intended for harvest that are released from federally operated or financed hatcheries, in carrying out its responsibilities to protect threatened and endangered salmon species. Marked fish must have a visible mark readily identifiable by commercial and recreational fishers. (Thus, the requirement enables fishers to distinguish hatchery fish from protected wild stocks.)

This section authorizes Indian Affairs, during FY2026 and notwithstanding any other provision of law, to record obligations against accounts receivable from state, local, and tribal governments (or their political subdivisions) for cooperative work, provided total obligations at fiscal year-end do not exceed total budgetary resources available at fiscal year-end.

This section establishes the Department of the Interior Experienced Services Program, authorizing the Secretary of the Interior— notwithstanding other federal grant and cooperative agreement laws— to make grants to or enter into cooperative agreements with private nonprofit organizations designated by the Secretary of Labor under title V of the Older Americans Act of 1965 (i.e., Senior Community Service Employment Program, which provides community service work and training for low-income individuals age 55 and older). Prior to any such award, the Secretary must ensure the agreement or grant does not (1) displace current department employees (including via reduced hours, wages, or benefits); (2) assign program participants to jobs where a federal employee is in layoff status from the same or equivalent position; or (3) affect existing service contracts.

This section authorizes the Secretary of the Interior to transfer funds among and between the Bureau of Indian Affairs, the Bureau of Indian Education, and successor offices and bureaus affected by the reorganization to implement an orderly transition to separate accounts, subject to the Act's reprogramming guidelines.

This section requires the head of the Bureau of Safety and Environmental Enforcement or the Bureau of Ocean Energy Management to post on the bureau's publicly available website a description of any prescribed or approved departure or alternate procedure or equipment use regarding a plan or permit under 30 CFR 585.103, 550.141, 550.142, 250.141, or 250.142, not more than 15 business days after issuance. The head of each bureau may exclude confidential business information.

This section authorizes the Secretary of the Interior, acting through the Director of the National Park Service, to convey to Virginia or the District of Columbia—upon their request—approximately 4.4 acres of National Park Service land identified as “Permanent Impact to NPS Land” on the map dated May 15, 2020, for rail and related infrastructure construction associated with the Long Bridge Project (i.e., the rail project from Rosslyn Interlocking in Arlington, Virginia, to L’Enfant Interlocking in Washington, DC, including a bicycle and pedestrian bridge). The conveyance is subject to terms set by the Secretary (including reversion to the National Park Service, after restoration, if no longer used for the project); allows mutual minor boundary adjustments or map corrections; and expires upon completion.

This section authorizes federally recognized Indian tribes or authorized tribal organizations receiving Tribally Controlled Schools Act grants (Public Law 100-297; i.e., federal grants for operating Bureau of Indian Education-funded elementary and secondary schools serving Indian students) to obtain interagency motor pool vehicles and related services for grant activities, notwithstanding other laws or regulations, to the same extent as tribes under contracts pursuant to the Indian Self-Determination and Education Assistance Act.

This section authorizes the Secretary of the Interior to use funds available in FY2026 to the Department's Appraisal and Valuation Services Office to establish higher minimum rates of basic pay up to 15% above normally scheduled minimum rates for appraisers in the GS-1171 job series at grades 11 through 15 who conduct real property appraisals and appraisal reviews in support of the Department's realty programs. Such rates must be consistent with 5 U.S.C. 5305(e)-(h). (As background, 5 U.S.C. 5305 authorizes special pay rates to address federal recruitment and retention challenges in specific occupations, areas, or working conditions.)

This section prohibits the Secretary of the Interior from using any appropriated funds to write or issue, under section 4 of the Endangered Species Act of 1973 (16 U.S.C. 1533), (1) a proposed rule for greater sage-grouse (Centrocercus urophasianus); or (2) a proposed rule for the Columbia Basin distinct population segment of greater sage-grouse. (Section 4 of the ESA requires the Secretary to determine whether species warrant listing as endangered or threatened and to publish proposed rules accordingly.)

This section authorizes the National Park Service to retain up to 7% of amounts appropriated for the Land and Water Conservation Fund (LWCF) state assistance program (54 U.S.C. 200305)—which provides matching grants to states for outdoor recreation planning, land acquisition, and development—to award as matching grants to states, the District of Columbia, and insular areas for state program administrative costs.

This section authorizes the Secretary of the Interior, in FY2026 and FY2027, to execute agreements among two or more component bureaus and offices of the Department of the Interior to achieve operating efficiencies through (1) co-locating in facilities leased or owned by such bureaus or offices and sharing related utilities and equipment; (2) detailing or assigning staff on a non-reimbursable basis for up to five business days; and (3) sharing staff and equipment necessary to meet mission requirements. Such agreements must support areas of mission alignment or geographic proximity, with participating bureaus and offices bearing costs proportionate to their approximate benefit and share of total costs (which may include indirect costs); the Secretary may make related fund transfers in advance or on a reimbursable basis.

This section extends the contribution authority for the Office of Financial Research (OFR) through each fiscal year thereafter (from through FY2024). (As background, the authority permits designated federal financial regulators—such as the Federal Reserve, FDIC, OCC, and SEC—to make contributions to fund OFR operations in support of the Financial Stability Oversight Council.)

This section authorizes the Secretary of the Interior to recruit and directly appoint qualified individuals—certified as maintaining a permanent and exclusive residence in the vicinity of a field unit—into competitive service positions at or below GS-9 or WG-15 (or equivalent) within that field unit, consistent with civil service merit principles and public notice requirements and in compliance with applicable examination and selection provisions.

This section revises permit extension authority under the first section of P.L. 99-338, as amended, by (1) increasing the maximum number of renewals from 3 to 7; and (2) striking the reference to Southern California Edison Company.

This section revises grant eligibility and governing board requirements under the Native Hawaiian Culture and Art Development Act (20 U.S.C. 4441), which authorizes the Secretary of the Interior to make grants to eligible organizations for programs supporting Native Hawaiian or Alaska Native culture and arts development. Specifically, it (1) broadens eligible grant recipients to any nonprofit organization or institution (from private nonprofit); and (2) for grants related to Native Hawaiian art and culture, revises governing board membership requirements to include Native Hawaiians and individuals widely recognized in Native Hawaiian art and culture (from requiring members to be such individuals) and to serve for a fixed term, while eliminating prior requirements to include representatives from the Office of Hawaiian Affairs, the president of the University of Hawaii, and the president of the Bishop Museum.

This section directs the Secretary of the Interior, within 30 days of enactment, to reinstate the name "Denali" for the mountain located at 63.0692° N, 151.0070° W in Alaska—consistent with the statutory authority for federal geographic naming (43 U.S.C. 364 et seq., under which the Secretary and U.S. Board on Geographic Names standardize names across the federal government)—and to update the U.S. Geological Survey's (USGS) Geographic Names Information System and Science Data Catalog using specified funds; requires the Secretary, within 60 days of enactment, to update all public-facing materials (e.g., signage, websites) using Leadership and Administration funds; and deems any prior federal reference to the mountain a reference to "Denali." The section further prohibits any federal funds, including in FY2026 appropriations or any other Act, from being used by the President, Secretary, or U.S. Board on Geographic Names to designate the mountain by any name other than "Denali." Finally, this section provides $1,000,000 in additional funding for Departmental Operations—Office of the Secretary—Leadership and Administration upon completion of the required updates.

This section directs the Department of the Interior to maintain all federal lands designated as, or part of, a national park unit, national scenic or historic trail, or wild and scenic river as of May 2, 2025, as federal land and to continue operating them as National Park Service entities, including through federal employee staffing and entry, permit, and other fee collections.

This section prohibits the use of any funds appropriated by this Act for activities or the publication or distribution of literature that promote public support for or opposition to any legislative proposal on which congressional action is not complete, except for communications to Members of Congress as permitted under 18 U.S.C. 1913 (the general anti-lobbying statute).

This section requires disclosure of the amount and basis of estimated overhead charges, deductions, reserves, or holdbacks—including working capital fund charges—from programs, projects, activities, and subactivities to support government-wide, departmental, agency, or bureau administrative functions or headquarters, regional, or central operations in annual budget justifications, subject to approval by the House and Senate Committees on Appropriations. Changes to such estimates must be presented to those committees for approval at least 90 days before implementation.

This section prohibits the obligation or expenditure of funds appropriated by this Act to accept or process patent applications for any mining or mill site claim located under the general mining laws, except for applications filed with the Secretary of the Interior on or before September 30, 1994, that fully complied with applicable statutory requirements (30 U.S.C. 29, 30, 35, 36, 37, 42) by that date. The section requires the Secretary to submit a report by September 30, 2027, to the House and Senate Committees on Appropriations and the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources on Department of the Interior actions under the plan required by section 314(c) of P.L. 104-208; and authorizes eligible applicants to fund third-party contractors selected by the Bureau of Land Management to conduct mineral examinations of the claims or mill sites.

This section limits fiscal year 2026 contract support costs—reimbursements to tribes for administrative costs of self-determination or self-governance contracts, grants, compacts, or annual funding agreements with the Bureau of Indian Affairs (BIA), Bureau of Indian Education (BIE), and Indian Health Service (IHS)—to amounts appropriated by this Act under the headings “Department of Health and Human Services, Indian Health Service, Contract Support Costs” and “Department of the Interior, Bureau of Indian Affairs and Bureau of Indian Education, Contract Support Costs.” Such amounts are not available for claims or repayments related to contract support costs for prior fiscal years, including settlements or judgments.

This section provides that the Secretary of Agriculture is not in violation of the Forest and Rangeland Renewable Resources Planning Act requirement to revise land and resource management plans for National Forest System units at least every 15 years (16 U.S.C. 1604(f)(5)(A)) solely because more than 15 years have passed without revision. The exemption does not apply if the Secretary fails to act expeditiously and in good faith, within available funding, to revise such a plan—in which case it is void as to that plan and a court may order accelerated completion—and does not relieve compliance with other requirements of the act or other laws.

This section prohibits funds appropriated by this Act from being used for preleasing, leasing, and related activities under the Mineral Leasing Act (i.e., onshore oil, gas, and other minerals) or the Outer Continental Shelf Lands Act (i.e., offshore oil and gas) within the boundaries—as of January 20, 2001—of National Monuments established under the Antiquities Act of 1906 (16 U.S.C. 431 et seq.), except where authorized by the establishing presidential proclamation.

This section prohibits the expenditure of funds appropriated by this Act for filing declarations of taking or complaints in condemnation (i.e., eminent domain actions) to acquire lands or interests in lands without advance notification to and approval by the House and Senate Committees on Appropriations. The prohibition does not apply to funds appropriated to implement the Everglades National Park Protection and Expansion Act of 1989 or for federal assistance to Florida to acquire lands for Everglades restoration.

This section prohibits executive branch agencies from using funds appropriated by this Act to enter into any federal contract unless the contract complies with Chapter 33 of title 41, United States Code; Chapter 137 of title 10, United States Code; or the Federal Acquisition Regulation. Exceptions apply if (1) federal law specifically authorizes a contract without these requirements, including formula grants to states or federally recognized Indian tribes; (2) the contract is authorized by the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5301 et seq.) or other federal laws specifically authorizing contracts with an Indian tribe as defined in section 4(e) of that Act (25 U.S.C. 5304(e)); or (3) the contract was awarded prior to enactment of this Act.

This section requires agencies receiving funds under this Act to post on their public websites reports required by Congress in this or any other Act, upon a determination by the agency head that it serves the national interest, unless posting would compromise national security or reveal proprietary information. Agencies must provide such reports to the requesting congressional committees for at least 45 days prior to public posting.

This section establishes guidelines for grants awarded by the National Endowment for the Arts as follows: (1) limits grants to individuals to literature fellowships, National Heritage Fellowships, or American Jazz Masters Fellowships; (2) requires procedures to prevent most grantees—except state or local arts agencies or regional groups—from using grant funds to subgrant to other organizations or individuals for independent activities (while allowing payments for goods and services); and (3) prohibits use of grants for seasonal support to groups unless the application specifies season contents, including identified programs or projects.

This section directs the Chairperson of the National Endowment for the Arts, in providing services or awarding financial assistance under the National Foundation on the Arts and the Humanities Act of 1965 using funds appropriated by this Act, to prioritize projects, productions, workshops, or programs serving underserved populations (i.e., urban minorities historically outside arts programs due to poverty or geographic isolation, with poverty defined per the Community Services Block Grant Act (42 U.S.C. 9902(2))) and those encouraging public knowledge, education, understanding, and appreciation of the arts. For funds carrying out section 5 of that Act, the section further requires the Chairperson to (1) establish a grant category for projects of national impact or availability or able to tour several states; (2) limit grants to no more than 15%, in the aggregate, of such funds to any single state, excluding grants under (1); (3) report annually to Congress on grants awarded by state and category under section 5; and (4) encourage grants to improve and support community-based music performance and education.

This section requires the Department of the Interior, Environmental Protection Agency, Forest Service, and Indian Health Service to provide monthly reports to the House and Senate Committees on Appropriations on the status of balances of appropriations, including all uncommitted, committed, obligated, and unobligated funds in each program and activity, beginning within 30 days of enactment of this Act.

This section provides that the terms and conditions of section 325 of Public Law 108-108 (117 Stat. 1307)—regarding grazing permits issued by the Forest Service on lands not subject to administration under 43 U.S.C. 1752—remain in effect for fiscal year 2026.

This section prohibits the use of funds appropriated by this Act to maintain or establish a computer network unless the network is designed to block access to pornography websites. Subsection (b) exempts such funds necessary for federal, state, tribal, or local law enforcement agencies or other entities conducting criminal investigations, prosecutions, or adjudications.

This section authorizes the Secretary of the Interior, for Bureau of Land Management lands, and the Secretary of the Agriculture, for Forest Service lands (referred to as the “Secretary concerned”), to transfer excess wild horses and burros removed from public lands to other Federal, State, or local government agencies for use as work animals, notwithstanding any other provision of law. Such transfers may occur immediately upon request by the receiving agency, and transferred animals lose their status as wild free-roaming horses or burros. Receiving agencies are prohibited from (1) destroying a transferred horse or burro into a commercial product; (2) selling or transferring it in a manner resulting in such destruction; or (3) euthanizing it except on a licensed veterinarian's recommendation for severe injury, illness, or advanced age. The section further prohibits use of appropriated funds for (1) destruction of any healthy, unadopted wild horse or burro under the Secretary concerned's jurisdiction (including by contractors) or (2) sale of a wild horse or burro resulting in its processing into a commercial product.

This section requires all iron and steel products used in projects for the construction, alteration, maintenance, or repair of public water systems or treatment works funded by a state drinking water revolving fund (i.e., under the Drinking Water State Revolving Fund program, 42 U.S.C. 300j-12) to be produced in the United States. Iron and steel products include lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The section authorizes the EPA Administrator to waive this requirement if (1) applying it would be inconsistent with the public interest, (2) such products are not produced in the United States in sufficient and reasonably available quantities and of satisfactory quality, or (3) their inclusion increases overall project costs by more than 25 percent. For waiver requests, the Administrator must make the request and related information publicly available electronically (including on EPA's website) and allow at least 15 days for informal public input prior to deciding. The section requires the provision to be applied consistent with U.S. international obligations and authorizes EPA to retain up to 0.25% of funds appropriated for Clean Water and Drinking Water State Revolving Funds to manage and oversee the requirements.

This section authorizes the Secretary of the Interior to enter into grants and cooperative agreements with volunteer fire departments, rural fire departments, rangeland fire protection associations, and similar organizations to provide wildland fire training and equipment, including supplies and communication devices. The section further authorizes the Secretary to transfer title to excess Department of the Interior firefighting equipment no longer needed for the department's wildland fire management program to such organizations, notwithstanding 40 U.S.C. §§ 121(c) and 521. (Thus, these transfers bypass standard federal excess property disposal procedures under GSA authority that otherwise promote maximum use of excess property among executive agencies and specified organizations.)

This section prohibits reprogramming of funds appropriated by this Act or in prior fiscal years without advance notification to and approval by the House and Senate Committees on Appropriations, in accordance with procedures in the Act's accompanying report.

This section extends the U.S. Forest Service's authority to collect fees for the commercial harvest of forest botanical products (e.g., mushrooms, ginseng, and decorative greens) from national forests through FY2026 (from FY2019).

This section prohibits the use of funds appropriated by this Act to accept nominations for or offer oil and gas leases on federal lands within the withdrawal area identified on the map of the Chaco Culture National Historical Park prepared by the Bureau of Land Management and dated April 2, 2019, prior to completion of the cultural resources investigation specified in the explanatory statement described in section 4 preceding division A of the Consolidated Appropriations Act, 2021 (P.L. 116-260). (Chaco Culture National Historical Park preserves Ancestral Puebloan archaeological sites; the withdrawal area protects surrounding federal lands from energy development to avoid damage to cultural resources.)

This section establishes that, for any lease under section 105(l) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5324(l))—which authorizes tribes and tribal organizations to lease real property to the Departments of the Interior or Health and Human Services for self-determination contract activities—the initial lease term commences no earlier than the date of receipt of the lease proposal. It further directs the Secretaries of the Interior and Health and Human Services, jointly or separately, to consult with tribes and tribal organizations during FY2026 through public solicitation and other means on implementing a consistent and transparent process for such lease payments.

This section extends indefinitely the authority for the Forest Ecosystem Health and Recovery Fund (from through FY2020). (The fund allows the Forest Service to retain and use specified receipts for forest health and recovery projects, including hazardous fuels reduction, insect and disease management, and ecosystem restoration.)

This section directs the Secretaries of the Interior and Agriculture to allocate Land and Water Conservation Fund (LWCF) amounts for FY2026—available without further appropriation under 54 U.S.C. 200303(a)—to specified agencies, accounts, projects, and activities listed in an accompanying report table, within 45 days of enactment. It further requires those Secretaries to notify the House and Senate Committees on Appropriations at least 30 days before expending funds on any such project outside its specified tracts but within the relevant federal land unit or boundary. This section prohibits the President or designee from reallocating FY2026 LWCF amounts (or amounts under 54 U.S.C. 200402(c)) except as specified above, other than for continuing program administration up to the amounts so allocated. (Thus, LWCF funds support federal land acquisition, state recreation grants, and related conservation programs pursuant to the Great American Outdoors Act.) This section requires the Secretary of Agriculture and Secretary of the Interior, concurrent with the FY2027 President's budget, to submit to the appropriations committees (1) prioritized supplementary lists of Federal land acquisition and Forest Legacy projects—totaling at least half the full amount allocated to each relevant agency account under 54 U.S.C. 200303(c)(1)—identifying any completed or unexecutable prior allocations for potential reallocation; (2) project restrictions to those with an identified willing seller and initiated appraisal or market research; and (3) detailed project data sheets in the format of annual budget justifications.

This section directs the Secretaries of the Interior and Agriculture to submit quarterly reports to the House and Senate Committees on Appropriations on the status of balances for projects and activities funded by the National Parks and Public Land Legacy Restoration Fund and by the Land and Water Conservation Fund for amounts allocated under subsection (a)(2), including all uncommitted, committed, and unobligated funds. (The National Parks and Public Land Legacy Restoration Fund, established by the Great American Outdoors Act, supports deferred maintenance on federal lands managed by the National Park Service, Forest Service, U.S. Fish and Wildlife Service, Bureau of Land Management, and Bureau of Indian Affairs.)

This section directs the President to submit to the House and Senate Committees on Appropriations, not later than 90 days after enactment and every 90 days thereafter, a list of Land and Water Conservation Fund (LWCF) project allocations for the Department of the Interior and Department of Agriculture (including prior-year outstanding allocations), in accordance with 54 U.S.C. 200306. The list must specify proposed allocations by account, program, and project—including projects under consideration by the departments (e.g., those approved by regional or state offices or for which funds have been appropriated for a portion of multi-stage projects)—together with an assessment of each project's readiness for implementation as of the submission date. (The LWCF supports federal acquisition of land, water, and interests therein for national parks, forests, wildlife refuges, and related outdoor recreation and conservation purposes.)

This section directs the Secretary of Energy, the Secretary of Agriculture, and the Administrator of the Environmental Protection Agency to jointly (1) ensure consistent federal policy on forest bioenergy across all federal departments and agencies that recognizes the full benefits of forest biomass for energy, conservation, and responsible forest management; and (2) establish clear and simple policies for using forest biomass as an energy solution, including policies that (A) reflect its carbon neutrality and recognize it as a renewable energy source, provided such use does not cause conversion of forests to non-forest uses; (B) encourage private investment throughout the forest biomass supply chain (e.g., working forests, harvesting operations, forest bioenergy production, wood products manufacturing, and paper manufacturing); (C) encourage forest management to improve forest health; and (D) recognize state initiatives to produce and use forest biomass.

This section prohibits the use of funds appropriated by this Act to implement or enforce the EPA regulations issued on March 21, 2011, at 40 CFR part 60, subparts CCCC and DDDD (i.e., new source performance standards for commercial and industrial solid waste incineration units), with respect to small remote incinerator units (as defined therein) in Alaska. Until a subsequent regulation is issued, it requires the EPA Administrator to implement the law and regulations in effect prior to that date.

This section prohibits advertising timber sales in Forest Service Region 10 (Alaska) if appraised as deficit under residual value methodology (i.e., timber value insufficient to cover logging and stumpage costs plus normal profit and risk allowance). For western red cedar from such sales that is surplus to Alaska domestic processors, it requires offering to domestic processors in the contiguous 48 states at prevailing domestic prices, allows export of unsold volume to foreign markets at the timber sale holder's election, and permits all Alaska yellow cedar to be sold at prevailing export prices at the holder's election.

This section prohibits the use of funds appropriated by this Act or any other Act to promulgate or implement regulations requiring title V operating permits under the Clean Air Act for carbon dioxide, nitrous oxide, water vapor, or methane emissions from biological processes associated with livestock production. (Title V requires states to issue federally enforceable operating permits for major sources of regulated air pollutants.)

This section prohibits the use of any funds made available in this or any other Act to implement any provision in a rule requiring mandatory reporting of greenhouse gas emissions from manure management systems.

This section prohibits the use of funds appropriated by this or any other Act to regulate the lead content of ammunition, ammunition components, or fishing tackle under the Toxic Substances Control Act or any other law.

This section amends the firefighter premium pay cap waiver by striking the last sentence of subsection (a)(1) and inserting language disregarding, for cap-calculation purposes, any services performed during a given calendar year that generate payments payable in the subsequent calendar year. The section further applies the waivers of premium and overtime pay caps authorized in subsections (a) through (c) of that provision to fiscal year 2026.

This section authorizes the Secretaries of the Interior and Agriculture to waive, in whole or in part, the 25% nonfederal cost-sharing requirement for appropriate conservation projects on public lands carried out by qualified youth or conservation corps under the Public Lands Corps Act (16 U.S.C. 1729(a)(1)), allowing federal payment of up to 100% of costs (from not more than 75%).

This section directs the Department of the Interior and the Forest Service to maintain updated five-year deferred maintenance plans that, to the extent practicable, include a list of all outstanding deferred maintenance needs and to provide those plans to the Committee on a quarterly basis.

This section directs the Department of the Interior, the U.S. Forest Service, and the Environmental Protection Agency to submit quarterly estimates to the House and Senate Committees on Appropriations—within 30 days after each quarter ends—detailing costs to repair, restore, or remediate disaster damages to federal lands and infrastructure, and, for EPA, costs to repair and improve resiliency of drinking water and wastewater infrastructure damaged in states, territories, and tribal lands.

This section prohibits the use of any federal funds to close, halt development of, merge with or transfer to another function or program, reduce funding for, or otherwise diminish the operations of the Smithsonian American Women’s History Museum or the National Museum of the American Latino, both established by Public Law 116-260.

This section requires any agency receiving funds under this Act to provide written notice to the House and Senate Committees on Appropriations and the affected grantee or contractor not less than seven days after canceling any grant or contract valued at more than $200,000. The notice must include the reason for cancellation, background, justification, and legal authority.

This section requires all grants and cooperative agreements funded by this Act to be awarded to eligible recipients by not less than the average number of days between the enactment of annual appropriations for each of FY2019 through FY2022 plus 15 days and the enactment of this Act.

This section requires any agency receiving funds under this Act to provide written notice to the Committees on Appropriations of the House of Representatives and the Senate at least 45 days before executing any reorganization or workforce action that increases, decreases, or transfers functions affecting 10 staff members or 10% of the staffing of an existing affected program or office (whichever is less), as compared to actual staffing on the first day of the fiscal year—even without a change in funding and regardless of workforce action type (e.g., voluntary, involuntary, or incentive-based).

This section incorporates by reference funding allocations for specified Department of the Interior programs, projects, and activities—including Management of Lands and Resources, Operation of the National Park System, U.S. Geological Survey, Operation of Indian Programs, Environmental Programs and Management, and National Forest System—as detailed in 13 titled tables in the accompanying report.

This section prohibits the use of funds provided by this Act to transfer, merge, or shift funding between appropriations or program projects via the Economy Act (31 U.S.C. 1535)—which authorizes an agency to order goods or services from another agency if available more conveniently or cheaply than from commercial sources (e.g., working capital funds)—or similar mechanisms to pay compensation or benefits to federal employees, unless expressly authorized in the relevant appropriation or used to reimburse a detail fulfilling the receiving account's usual and longstanding functions.

This section prohibits using funds provided by the Act to terminate a lease or dispose of a federal building unless the committees of jurisdiction in the House and Senate receive written notice 180 days in advance disclosing (1) the property's exact location, including address if applicable; (2) current uses and federal occupants; (3) lease terms and annual lease costs, or direct federal costs of owning and maintaining the building; and (4) detailed plans related to personnel and activities currently on the property.

This section permanently rescinds $41 million in unobligated balances from prior discretionary appropriations for the Environmental Protection Agency—Buildings and Facilities account and $50 million from the John F. Kennedy Center for the Performing Arts—Capital Repair and Restoration account. No amounts designated by Congress as an emergency requirement pursuant to a concurrent resolution on the budget or the Balanced Budget and Emergency Deficit Control Act of 1985 may be rescinded.

This section repurposes $764,514,000 for Department of the Interior (DOI) wildland fire management and $67,000,000 for DOI Office of Inspector General by transfer from unobligated balances appropriated in division J of the Infrastructure Investment and Jobs Act (P.L. 117-58), as follows: (1) to wildland fire management, $250,000,000 from unobligated balances under Environmental Protection Agency State and Tribal Assistance Grants (amounts becoming available in FY2026 under paragraph (3)) and $515,060,000 from unobligated balances under DOI Office of Surface Mining Reclamation and Enforcement Abandoned Mine Reclamation Fund (amounts not available for wildfire suppression operations); and (2) to Office of Inspector General, $67,000,000 from unobligated balances—including amounts becoming available in FY2026—previously appropriated in division J and transferred (or to be transferred) to DOI Office of Inspector General for oversight of title VI, division J funding. Transferred amounts continue to be treated as specified in section 103(b) of division A of P.L. 118-5.
