S. 2463 — Eviction Right to Counsel Act of 2025

This section establishes the Eviction Right to Counsel Fund in the U.S. Treasury and authorizes appropriations of $100 million for each of FY2026 through 2030 to fund grants by the Secretary of Housing and Urban Development. It directs the Secretary to award grants to eligible entities—state governments (including the 50 states, District of Columbia, and U.S. territories or possessions), local governments, or Indian tribal governments (as defined in 42 U.S.C. 5122)—that enact or are fiscally responsible for implementing right-to-counsel legislation providing full legal representation at no cost to covered individuals (tenants with incomes at or below 200% of the federal poverty line) in covered proceedings (evictions from primary residences or terminations of housing subsidies). In selecting grantees, the Secretary must prioritize eligible entities that have enacted laws limiting no-fault evictions, requiring at least 30 days' written notice for evictions, establishing eviction diversion programs, or providing emergency rental assistance, or that will prioritize grant funds for attorney training and recruitment. Grant recipients may use funds for costs of right-to-counsel legislation, including training resources for attorneys representing covered individuals.
