S. 250 — Protecting Life in Foreign Assistance Act

This section states congressional findings on the history of the Mexico City Policy—which prohibits foreign nongovernmental organizations from performing or promoting abortions as a condition of receiving U.S. family planning assistance (later expanded and renamed Protecting Life in Global Health Assistance)—from its issuance by President Reagan in 1984 through its rescission by President Biden in 2021. It expresses the sense of Congress that the policy should be expanded to cover funding to foreign and domestic nongovernmental organizations, multilateral organizations, and subcontractors and that Congress should codify the policy to prevent inconsistency across presidential administrations.

This section prohibits federal funds from being made available for purposes outside the United States (including territories and possessions) to (1) foreign nonprofit organizations, foreign nongovernmental organizations, foreign multilateral organizations, or foreign quasi-autonomous nongovernmental organizations that perform or promote abortions (including providing referrals, counseling, lobbying, or training relating to abortions), furnish or develop any item intended to procure abortions, or provide financial support to any entity conducting such activities or to specified domestic organizations; or (2) domestic nonprofit organizations or domestic nongovernmental organizations that perform abortions, furnish or develop any item intended to procure abortions, perform or promote abortions within the scope of any federally funded program or activity (or fail to maintain complete physical and financial separation from such activities, including co-location at the same site), or provide financial support to any entity conducting such activities or to specified foreign organizations. The prohibitions include the transfer of federal funds and goods financed with such funds.
