S. 2512 — EATS Act of 2025

This section amends the Food and Nutrition Act of 2008 to make bona fide students enrolled at least half-time in any recognized school, training program, or institution of higher education ineligible for the Supplemental Nutrition Assistance Program (SNAP). (Previously, such students were ineligible under section 6(e) unless they met specific exceptions, such as working at least 20 hours per week, participating in approved work-study, or having a dependent child under age 6.) It does so by (1) adding such students to SNAP's separate household definition (7 U.S.C. 2012(m)(5)); (2) striking the exception language from section 6(d)(2)(C) (7 U.S.C. 2015(d)(2)(C)); (3) striking former section 6(e); and (4) redesignating subsections (f) through (s) as (e) through (r). The section makes conforming amendments to update cross-references throughout the Food and Nutrition Act and in other laws, including the Workforce Innovation and Opportunity Act (29 U.S.C. 3113(a)(2)(D), 3151(b)(2)(B)(iv)) and Social Security Act (42 U.S.C. 654).
