S. 2563 — Global Investment in American Jobs Act of 2025

This section establishes definitions for purposes of the Act, including (1) "foreign country of concern," as given in section 9901 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (15 U.S.C. 4651); (2) "responsible private sector entity," meaning an entity determined by the Secretary to be not organized under the laws of a foreign country of concern and not owned by, controlled by, or subject to the influence of a foreign country of concern; (3) "Secretary," meaning the Secretary of Commerce; and (4) "trusted country," meaning a country that is not a foreign country of concern.

This section expresses the sense of Congress that attracting foreign direct investment from responsible private sector entities in trusted countries enhances U.S. economic prosperity, global competitiveness, and security by removing unnecessary barriers, promoting U.S. leadership in technologies such as artificial intelligence and quantum computing, ensuring resilient supply chains, and addressing data localization and intellectual property issues, while mitigating threats from entities owned or influenced by foreign countries of concern.

This section directs the Secretary of Commerce and the Comptroller General of the United States, in consultation with relevant interagency working groups and federal agency heads, to conduct an interagency review of U.S. global competitiveness in attracting foreign direct investment (FDI) from responsible private sector entities based in trusted countries, focusing on foreign trade barriers faced by advanced technology sectors in the global digital economy. The review must assess 15 specified matters, including (1) current economic impacts of FDI on U.S. manufacturing, services, digital trade, and jobs; (2) global investment and data flow trends; (3) federal policies facilitating FDI; (4) FDI versus domestic investment and greenfield versus merger/acquisition activity; (5) challenges from state-owned or state-backed enterprises, particularly from state-directed economies and countries of concern (e.g., circumvention efforts by the Chinese Communist Party); (6) trusted countries' approaches and best practices; (7) protectionist barriers abroad (e.g., data localization, subsidies, IP infringement); and (8) adequacy of U.S. efforts. The review excludes laws or policies relating to the Committee on Foreign Investment in the United States (CFIUS); requires Federal Register notices and public comment periods before initiation and prior to finalizing the report; and culminates in a report to Congress, due not later than one year after enactment, with recommendations to enhance U.S. FDI competitiveness while maintaining security, labor, consumer, financial, and environmental protections.
