S. 257 — Promoting Resilient Supply Chains Act of 2025

This section designates the Act as the “Promoting Resilient Supply Chains Act of 2025” and sets forth the table of contents.

This section assigns additional responsibilities to the Assistant Secretary of Commerce for Industry and Analysis, as follows: (1) in consultation with the Secretary of Homeland Security, promote the stability and resilience of critical supply chains and critical and emerging technologies that strengthen U.S. national security; (2) lead the Working Group established under section 3 and consult nongovernmental representatives, industry, institutions of higher education, and state and local governments to promote resilient critical supply chains and identify, prepare for, and respond to supply chain shocks affecting critical industries, supply chains, and emerging technologies; (3) encourage the growth and competitiveness of U.S. production and manufacturing of emerging technologies; (4) in consultation with the Secretary of Homeland Security, assess the resilience, diversity, and strength of critical supply chains and critical and emerging technologies; (5) in consultation with the Secretary of State and the United States Trade Representative, support the availability of critical goods from domestic manufacturers and enterprises or from allies and key international partners; (6) assist the federal government in preparing for and responding to supply chain shocks to critical supply chains, including by improving flexible U.S. manufacturing capacities; (7) consistent with U.S. international agreements, encourage domestic enterprises and manufacturers to reduce reliance on critical goods from countries described in section 7(2)(B); and (8) encourage relocation of manufacturing facilities producing critical goods from such countries to the United States or allies and key international partners to strengthen critical supply chain resilience, diversity, and strength.

This section establishes the Supply Chain Resilience Working Group, to be formed by the Assistant Secretary not later than 120 days after enactment and composed of representatives from federal agencies relying on the Industry and Analysis business unit, including the Departments of State, Defense, Homeland Security, Transportation, Energy, Agriculture, Interior, and Health and Human Services; the Office of the Director of National Intelligence; and the Small Business Administration. It directs the Assistant Secretary, not later than 120 days after enactment, to designate critical industries, critical supply chains, and critical goods (with public comment and updates at least every four years) and, not later than one year after enactment, to (1) assess, map, and model critical supply chains (including for critical and emerging technologies); identify gaps, vulnerabilities, and potential shocks; evaluate domestic and allied manufacturing capacity, market stability effects, and the manufacturing workforce; and identify relevant risk assessment tools, all in consultation with the working group; and (2) identify resilience opportunities, encourage multistakeholder consultations, build capacity in the United States and among allies, and develop contingency plans, in consultation with state and local governments, the working group, and allies as appropriate. It further requires the Assistant Secretary to submit to congressional committees, not later than one year after enactment, a report detailing supply chain activities conducted, data collected and analyzed, and necessary risk assessment tools.

This section directs the Secretary of Commerce to produce a report identifying and assessing Department of Commerce offices and bureaus relevant to critical supply chain resilience and manufacturing innovation—including their duties, responsibilities, resources, programs, expertise, purpose, legal authority, effectiveness, efficiency, and limitations—and providing recommendations to enhance related activities through improved effectiveness and coordination within the department and consultation with other agencies. The section further requires submission of the report, along with an implementation strategy as determined appropriate by the Secretary, to relevant congressional committees not later than two years after the date of enactment.

This section defines terms used in the Act, including “agency” (as defined in 5 U.S.C. §551); “ally or key international partner nation” (a country critical to addressing supply chain weaknesses, excluding national security risks or countries listed in specified ransomware law); “covered nongovernmental representative” (representatives specified in 19 U.S.C. §2155(b)(1), excluding non-Federal government representatives); “critical good” (materials, products, or items whose absence would debilitate U.S. national or economic security, critical infrastructure, or emerging technology); “critical industry” and “critical supply chain” (industries and supply chains for critical goods); “domestic enterprise” and “domestic manufacturer” (U.S.-based businesses procuring or manufacturing critical goods); “emerging technology” (specified technologies critical to national or economic security, including artificial intelligence, quantum computing, semiconductors, and others); “manufacture” and “manufacturing technology” (activities and technologies necessary for critical good production, excluding unrelated software); and “resilient critical supply chain” (a critical supply chain ensuring U.S. sustenance of critical industries and emerging technologies).
