S. 2574 — Prohibition of Agricultural Land for Foreign Adversaries Act

This section establishes definitions for purposes of the Act. Such terms include (1) "agricultural land," which has the meaning given in section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (7 U.S.C. 3508) (i.e., land used for agricultural, forestry, or timber production, as determined by the Secretary of Agriculture); (2) "covered person," meaning an individual or entity associated with the government of the Democratic People's Republic of Korea, the Islamic Republic of Iran, the People's Republic of China, or the Russian Federation; and (3) "United States," to include any State, territory, or possession of the United States.

This section directs the President to prohibit covered persons (i.e., persons associated with certain foreign governments) from purchasing public or private agricultural land, including ranching land, in the United States, notwithstanding any other provision of law. The section authorizes the President to implement the prohibition using all authorities under sections 203 and 205 of the International Emergency Economic Powers Act (IEEPA; 50 U.S.C. 1702 and 1704) and subjects violators to civil and criminal penalties under IEEPA section 206(b)-(c) (50 U.S.C. 1705(b)-(c)).

This section directs the President, notwithstanding other law, to prohibit covered persons (i.e., persons associated with certain foreign governments) from participating in Department of Agriculture programs, except for programs relating to food inspection or other food safety regulatory requirements.
