S. 2576 — Election Mail Act

This section directs the U.S. Postal Service to process and clear, to the maximum extent practicable, any absentee ballot for a federal election—excluding those for armed forces and overseas voters under 39 U.S.C. §3406—on the same day it is received at a postal facility or post office. (Federal election means a general, special, primary, or runoff election for President, Vice President, Senator, Representative, Delegate, or Resident Commissioner.) It also updates chapter headings and tables of contents in title 39, U.S. Code, to include "Election Mail," with the requirements applying to elections occurring on or after 60 days after enactment.

This section establishes a new requirement under the Help America Vote Act of 2002 (HAVA) that each state and jurisdiction (including territories) provide an intelligent mail barcode—as prescribed by the U.S. Postal Service—on the return envelope for each ballot sent by mail in federal elections occurring on or after January 1, 2026 (with an exception for states or jurisdictions using alternative systems enabling voters to track ballots through the mail). It applies HAVA enforcement provisions (currently limited to voting system standards) to noncompliance with this requirement and makes conforming and clerical amendments, including redesignating existing HAVA sections 311 and 312 as 321 and 322, subtitle B as subtitle C, and adding the new provision to the table of contents.

This section requires the U.S. Postal Service to indicate on envelopes for absentee ballots in federal elections—via postmark or otherwise—that the ballot was carried by the Postal Service and the mailing date (new 39 U.S.C. 3408), effective for elections occurring on or after 60 days after enactment. This section also adds new requirements under the Help America Vote Act of 2002 (HAVA) for state and local election officials to enhance visibility of official ballots in federal elections by (1) affixing Postal Service Tag 191 (or successor) to trays or sacks, (2) using the Official Election Mail logo, and (3) ensuring visibility of intelligent mail barcode service type identifiers if used (new HAVA §312); these requirements apply to elections occurring on or after 60 days after enactment. Additionally, this section directs the Election Assistance Commission to issue voluntary guidance to assist states in complying with HAVA §312 by the effective date of that section (i.e., 60 days after enactment; amends 52 U.S.C. 21101(b) by adding new paragraph (4)).

This section adds a new section 3409 to chapter 34 of title 39, United States Code, requiring (1) carriage of domestic election mail—defined as voter registration forms or cards, absentee or mail-in ballot applications or ballots, and related materials for federal elections mailed by state or local officials (excluding Uniformed and Overseas Citizens Absentee Voting Act materials under section 3406)—according to first-class mail service standards; (2) free postage for completed absentee or mail-in ballots (excluding section 3406 materials); (3) no operational changes restricting prompt delivery during the 120-day period ending on the date of a federal election, including removing collection boxes without immediate replacement or decommissioning sorting machines except for routine maintenance; and (4) appointment of an Election Mail Coordinator at each Postal Service area and district office to share information with election officials. The section also amends the revenue forgone reimbursement provision at 39 U.S.C. §2401(c) to include section 3409 and applies 180 days after enactment.

This section requires the Postmaster General to consult annually with Indian Tribes on United States Postal Service issues that present barriers to voting for eligible voters living on Indian lands. It defines Indian lands to include (1) Indian country, as defined in 18 U.S.C. §1151, of an Indian Tribe; (2) certain Alaska Native Claims Settlement Act lands owned by Native villages or associated Village Corporations; (3) land on which an Indian Tribe's seat of government is located; and (4) Tribal designated statistical areas or Alaska Native village statistical areas associated with an Indian Tribe, as defined by the Bureau of the Census; and defines Indian Tribe as any federally recognized tribe, band, nation, pueblo, village, or community listed pursuant to the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. §5131).

This section establishes a uniform nationwide deadline for state and local election officials to accept and process mailed ballots in federal elections if the ballot is postmarked or otherwise indicated by the U.S. Postal Service as mailed on or before election day and received within the seven-day period beginning on the day after the election. The requirement applies to the regularly scheduled general election for federal office in November 2026 and each succeeding federal election.
