§201.Emergency appropriations for Department of Defense assistance to Ukraine
This section appropriates $30 billion in emergency funding for FY2025 to “Operations and Maintenance, Defense-Wide,” available until September 30, 2026, to respond to the situation in Ukraine, of which (1) $15 billion, available until September 30, 2027, is for the Ukraine Security Assistance Initiative (USAI)—a program enabling the Department of Defense to procure and provide defense articles and services directly to Ukraine under specified terms—and (2) $15 billion, available until September 30, 2025, is transferable to “Operation and Maintenance,” “Procurement,” and “Revolving and Management Funds” accounts for replenishing Department stocks or reimbursing aid provided to Ukraine or its supporters (with 15-day prior notice to congressional defense committees and authority to transfer unused funds back). Subsection (b) directs that funds for Ukraine prioritize specific capabilities, including air defense systems (e.g., PATRIOT, NASAMS), man-portable missiles (e.g., Javelin, Stinger), aircraft and munitions, artillery systems (e.g., HIMARS, 155mm rounds), tanks, coastal defenses (e.g., Harpoon), and other equipment. This section further appropriates $2 billion in emergency funding for FY2025, available until September 30, 2027, transferable to “Operations and Maintenance,” “Procurement,” and “Revolving and Management Funds” accounts to backfill aircraft, tanks, munitions, and anti-air and anti-tank weaponry provided by Poland, Lithuania, Latvia, Estonia, and other NATO members to Ukraine (with similar transfer, notice, and revert provisions).
